ORDINANCE N0. 79-40 <br />INTRODUCED BY: Council as a Whole <br />AN ORDINANCE ENACTING SECTION 1119.171 OF THE <br />CODIFIED ORDINANCE TO REQUIRE THE PLACEMENT <br />OF METAL BOUNDARY PINS IN SUBDIVISION LOTS. <br />WHEREAS, it has been brought to the attention o£ Council <br />that the resident purchasers of lots within new subdivisions <br />haveincurred difficulties in the location of lot boundaries thereby <br />necessitating the use of surveys to locate said boundaries; and <br />WHEREAS, Council desires to supplement the Codified <br />Ordinances of the Village concerning subdivisions so as to include <br />the requirement of the placement of pins delineating subdivision <br />lots by the developers subsequent to grading but prior to the <br />issuance of an occupancy permit; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 1119.171 of the Codified Ordinances <br />of Mayfield Village is hereby enacted to read as follows: <br />1119.171 Identification of Lot Boundaries. The developer <br />shall install metal pins indicating the location of <br />subdivision lot boundaries which,pins need not be installed <br />prior to grading but which must be permanently affixed to <br />the parcels prior to the issuance of an occupancy permit. <br />The developer shall furnish to the Buildinq Commissioner a <br />certificate evidencing the placement oP the pins as required <br />by this Section. <br />Section 2. This Ordinance is hereby declared to be an <br />emerqency measure necessary for the immediate preservation of the <br />public peace, health, safety and welfare of the residents of Mayfield <br />Village in that it will aid in determining the proper boundary lines <br />£or residential property owners thus eliminating residential disputes <br />over such property lines.
