FHiL E U 7- !E .7y <br />RESOLUTION N0. 79- 46 <br />INTRODUCED BY: Mr. Busa <br />A RESOLUTION SUPPORTING REPEAL OF THE OHIO <br />PREVAILING WAGE LAW AND AUTHORIZING THE LAW <br />DEPARTMENT AND THE FINANCE DIRECTOR TO RESIST <br />ANY ATTEMPT TO IMPOSE THE PREVAILING WAGE LAW <br />ON THIS MUNICIPALITY IN VIOLATION OF ITS HOME <br />RULE POWERS. <br />WHEREAS, the Ohio Prevailing Wage Law enacted as Sections <br />4115.01 through 4115.06 of the Ohio Revised Code require that this <br />municipality include a clause in all contracts that certain <br />"prevailing wages" as dictated by a schedule imposed upon this <br />municipality by the State of Ohio be paid to all workers in such <br />contract; and <br />WHEREAS, this Council determines that this has cost the <br />taxpayers money, both in the fact that contractors raise bids to <br />account for the fact that they are not able to use the least expen- <br />sive labor available and in the fact that the paperwork required in <br />both the contractor and the municipality to comply with the pre- <br />vailing wage law is burdensome; and <br />WHEREAS, this is a Home Rule municipality deriving its <br />powers directly from the people which it governs, leaving the State <br />of Ohio no constitutional right to impose its will on this <br />municipality to the detriment of its taxpayers; and <br />WHEREAS, House Bill 544 currently before the legislature <br />of the State of Ohio proposes a repeal of the prevailing wage laws; <br />now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, OHIO, THAT: <br />Section 1. This Council is on record as favoring <br />the passage of House Bill 544 for the repeal of the prevailing <br />wage law. <br />Section 2. This Council hereby determines that it <br />is in the best interests of this community for the Law Department <br />and the Finance Director to actively oppose any attempt by the <br />State of Ohio to enforce the prevailing wage law with regard to <br />any contract of this municipality, since this would be a violation <br />of its Home Rule powers to the detriment of the residents herein. <br />Section 3. The Clerk is authorized, empowered and <br />directed to forward copies of this resolution to State Representa- <br />tive Leslie Brown, original sponsor of House Bill 544, State <br />Representative J. Leonard Camera, Chairman of the Commerce and <br />Labor Committee now hearing the Bill; and to Matthew Hatchedorian.
