? <br />RESOLUTION NO. 79-48 <br />INTRODUCED BY: Mr. Flynn <br />AN EMERGENCY RESOLUTION ENCOURAGING AND AUTIIORIZING <br />NEGOTIATIONS WITH CEI FOR STREET LIGHTING ON A JOINT <br />BASIS WITH OTHER MUNICIPALITIES; APPOINTING A++'MEMBER <br />TO THE NEGOTIATING TEAM; AND SUPPORTING THE CONCEPT <br />OF POOLED PURCHASING. <br />WHEREAS, the City of Mayfield Village has heretofore <br />contracted with the Cleveland Electric Illuminating Company for <br />street lighting, which contract was cancelled by CEI as of <br />December 31, 1978; and <br />WHEREAS, negotiations with CEI for a new contract has <br />thus far been ineffective and unproductive, due in part to the refusal <br />of CEI to consider cost and energy saving alternatives which this <br />Council deems desirable; and <br />WHEREAS, the negotiating ability of this municipality singly <br />is grossly disparate to that of CEI due to the vast quantity of <br />technical information required and the absence of realistic <br />alternatives to dealing with a large monopoly such as CEI; and <br />WHEREAS, through a pooling of resources and possible <br />pooled purchasing, innovative suggestions for a new contract designed <br />to save costs and reduce energy consumption are available to the <br />13 communities which have not yet signed new contracts for street <br />lighting with CEI; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1.' This municipality supports the concept o£ <br />combined negotiations between all municipalities which have not <br />as of this date signed contracts with CEI and CEI itself for the <br />purpose of reducing street lighting costs and energy consumption; <br />Section 2. , is hereby <br />appointed to a negotiating team consisting of one person from each <br />municipality interested in becoming part of such a negotiating <br />unit. The progress of the negotiations shall be reported to its <br />leqislative body periodically and no action of the negotiatinq <br />team shall be binding on this municipal corporation unless approved <br />by formal action of its legislative body. <br />Section 3. If it is demonstrated that one or more <br />municipalities can enter a power purchasing agreement at a cost <br />saving then Council would support the concept of such an agreement. <br />Section 4. The Clerk is authorized and directed to certify <br />a copy of this resolution to the Clerk of the City of University
