ORDINANCS t10. 79-70 <br />INTRODUCED BY: Mr. Grogan <br />AN EAIERGENCY ORDINANCE AUTHORIZING THE <br />MAYOR AND FIrIANCE DIRECTOR TO ENTER INTO <br />A COP7TRACT S9ITH THE CLF.VEI,AND ELECTRIC <br />ILLUMIiQATING COMPANY FOR STREET LIGHTING <br />SERVICE. <br />WHEREAS, the Cleveland Electric Illuminating Company <br />terminated its street lighting contract with the municipality <br />effective December 31, 1978; and <br />64HEREAS, the municipality has had no written contract <br />since January 1, 1919 for street lighting service; and <br />WHEREAS, the Cleveland Electric Illuminating Company <br />has informed the municipality that unless a street lighting <br />contract is signed the municipality will be charged for said service <br />at a rate far in excess of that offered in the proposed contract; <br />and <br />T4HEREAS, the street lighting service offered to the <br />municipality by the Cleveland Electric Illuminating Company is a <br />non-competitive item; noca, there£ore, <br />BE IT ORDAI2dED BY THE COiJNCIL OF MAYP'IELD VILLAGE, OHIO, THAT: <br />Section 1. Street lighting service is declared to be <br />non-comgetitive. <br />Section 2. The attached contract of the Cleveland <br />Electric Illuminatinq Company is declared to the best and only <br />bid available for street lighting service. The biayor and Finance <br />Director are hereby authorized and directed to execute the <br />attached contract for street lighting service with the Cleveland <br />Electric Illuminating Comoany for street lighting service providing <br />said contract qrants to the municipality the right to cancel at <br />any time during the five (5) year term with no surcnarge to the <br />municipality for that right and furthermore providinq that the <br />requirement of a minimum billing to the municipality of eighty <br />percent (80 %) of maximun billing is eliminated. <br />Section 3. This is an emergency ordinance immediately <br />necessary for the preservation of the health, safety and welfare <br />of the community in that it provides for essential street lighting <br />service.
