ORDINANCE NO. <br />Page -16- <br />unit shall conspiciougly disclose the tenant's right of <br />cancellation. <br />(k) Developer's Right of Access. <br />(1) The tenant in a conversion condominium development <br />shall not unreasonably withhold consent to the developer <br />to enter the unit in order to inspect the premises, make <br />necessary or agreed repairs, supply necessary or agreed <br />services or show the unit to a purchaser. <br />(2) Except in the case of an emErgency, or unless it <br />is impracticable to do so, the developer shall give the <br />tenant reasonable notice of his intent to enter and may <br />answer only at reasonable times. Twenty four (24) hours is <br />presumed to be a reasonable notice in the absence of evidence <br />to the contrary. <br />(3) The developer shall not abuse the right of access <br />or use it to harass the tenant. Entry by the developer in <br />excess of twice in any seven (7) day period for the purchase <br />of showing the unit to purchasers shall be presumed to be <br />an abuse of the right of access in the absence of evidence <br />to the contrary. <br />(1) Non-waiverability of Obligations and Rights. <br />Neither the obligations nor the rights under this <br />section 1379.06 may be waived in a contract o£ lease, a contract <br />o£ sale or otherwise, and any attemptedwaiver is void. <br />(m) Delivery o£ Public Offering Statement to Purchasers <br />Other Tenants. <br />(1) The developer shall deliver a copy of the Public <br />Offering Statement to a purchaser other than a tenant not <br />less than fifteen (15) days before the execution o£ a contract <br />for the purchase of a unit. <br />(2) On the day of delivery of the Public Of£ering <br />Statement, the developer shall obtain a receipt signed by <br />said purchaser acknowledqing that he has received the Public <br />Offering Statement and has also received a copy of said receipt <br />on that date. Such receipt shall be kept on file in the <br />possession of the developer for a period of two (2) years from <br />the date of delivery to and signature by the purchaser, and <br />said receipt shall be subject to inspection by Mayfield Village <br />at any reasonable time. <br />(n) Purchasers' Right to Cancel Contract. <br />(1) Unless the purchaser is given the Public Offering <br />Statement not less than fifteen (15) days before executing
