Ordinance No. 79-81 <br />Page -2- <br />CdJ The Village will, within its capabilities, endeavor to <br />accommodate every reasonable application for connection to the <br />police or fire alarm panels. <br />971.04. FEE REQUIRED: <br />Cia) For each alarm connected to the Police or FirE Alarm <br />Console from a residential premises there shall be a charge of <br />One Hundred Twenty Dollars ($120.00) per year, payable semi- <br />annually, in advance. <br />(bj' For each alarm connected to the Police or Fire Alarm <br />Console from a premises other than a residential premises there <br />shall be a charge of Three Hundred Sixty Dollars ($360.00) per <br />year, payable semi-annually, in advance. <br />(cT For purposes of this Section, each alarm connected to <br />both the Police and Fire Alarm Consoles shall be considered a <br />separate connection with a separate charge for each such connec- <br />tion. <br />471.05. LOCAL ALARMS: A permit for the installation of a <br />local alarm which, when activated, sounds a horn, bell, buzzer <br />or other type of audible alarm, shall be required if the sound <br />created by the alarm is audible beyond the premises served. <br />The Mayor, or Yris=aut?ho'r-ized.representative,-shall issue a permit <br />for such alarm, provided that the intensity of sound does not <br />exceed eighty-five (85) decibels at any location outside the <br />premises being served. <br />971.06. FALSE ALARMS: <br />Ca) No person shall fail to maintain equipment under his <br />contr-ol designed to give alarms of any type at less than the <br />level of maintenance necessary to prevent false alarms from being <br />emitted. <br />(b) It shall be prima facie evidence of unsatisfactory <br />maintenance in violation of Sec. 971.06(a•) if two (2) alarms are <br />emitted and reported in any manner to the Police or Fire Depart- <br />ments for which no external cause can be found, provided that <br />such alarms occur within six (6) months of each other. <br />(c) The penalty for violation of Sec. 971.06(a) shall be <br />Ten Dollars ($10.00) for a first offense and Twenty-five Dollars <br />($25.00)- for each subsequent offense. Prior to formal prosecu- <br />tion, the„per,son to be charged shall be notified of the alleged <br />violation and fine and shall be given not less than ten (10) days <br />nor more than twenty (20) days to voluntarily waive his right to <br />be charged and present a defense by signing a waiver and paying <br />the fine. Thereafter, prosecution may be instituted. Failure <br />to make satisfactory repairs after conviction under this Section <br />shall constitute a separate offense each day such condition <br />remains unabated. <br />(d) Notwithstanding the fine to be assessed, as set forth <br />hereinabove, no charge shall be made for a false alarm to which <br />there is no response by the Division of Police or the Division <br />of Fire nor when the cause has been proven to be an act of God.
