M.V. Ordinance No, 79-81 <br />Page -4- <br />Ci): All equipment, the use or installation of which is <br />subject to this ordinance, sha11 be maintained in good operating <br />condition. Repasrs shall be made whenever necessary to assure <br />proper operation. <br />(7) Tf any automatic detection or signaling device is not <br />properly maintained or results in the reporting of ten (10) or <br />more false alarms in any twelve (12) month period, the Mayor shall <br />serve written notice upon the permit holder of his intent to revoke <br />the permst. Such notice shall be given not less than seven (7) <br />days prsor to revocation. Such notice shall state the right of <br />the permit holder to appeal to the Council. If an appeal is <br />fsled in writing, the Council shall hold a hearing on the matter <br />and sha11 render a decision on the basis of the facts presented. <br />The Councsl decision shall be final. In the event no appeal is <br />filed, the Mayor shall cancel the permit. The connection to the <br />alarm console in the Police or Fire Departments shall be removed <br />or rendered inoperative upon cancellation of the permit. <br />(kj Any dev3ce designed to emit an alarm upon detection of <br />smoke, fire or unauthorized intrusion shall constitute a nuisance <br />if ten (lOJ or more false alarms are emitted and reported to the <br />Police or Fire Departments, or both, in any twelve (12) month <br />period. In that event, the Law Director shall take appropriate <br />civsl or criminal action to abate such nuisance. <br />971.08. LTABILITY OF MAYEIELD VILLAGE: The issuance of any <br />permit in conjunction w3th this Chapter shall not constitute <br />acceptance by the Village of any liability to maintain any equip- <br />ment, to answer alarms or for anything in connection therewith. <br />971.09. RULES AND REGULATIONS: The Mayor, or his designated <br />representative, shall make and enforce such rules and regulations <br />as he may deem necessary for the enforcement of the provisions <br />hereof and for the proper determination and collection of the fines, <br />fees and charges herein provided. <br />471.10. PERMIT FEE: Each application for a permit for <br />installation of any alarm covered by Section 971.03 shall be <br />accompanied by a fee of Fifty Dollars ($50.00). <br />Section 2. Violation of any provision of this Ordinance <br />shall constitute a misdemeanor of the fourth degree and shall be fined <br />accordingly except for a specific fine as set forth herein.
