ORDINANCE N0. 79- 85 <br />? INTRODUCED BY: Council as a Whole <br />AN ORDINANCE APPROPRIATING FEE <br />SIMPLE INTEREST IN THE REAL PROPERTY <br />LOCATED AT 6635 WILSON MILLS ROAD, <br />PdAYFIELD VILLAGE, OAIO <br />" WHEREAS, on the 15th day of January, 1979, the Council of <br />Mayfield Village, Ohio, adopted Resolution No. 79-5, declaring the <br />necessity and intention of appropriating the property described <br />in Exhibit "A", and notice of the adoption of said Resolution has <br />been served on the owners and those persons having an interest of <br />record in the premises; and <br />.:_ WHEREAS, the Council did, on the 15th day of October, 1979 <br />adopt Ordinance 79-76, appropriating fee simple interest in the <br />subject property; and <br />WHEREAS, it was then learned that there are additional <br />interested parties who should have been served notice of the <br />passage of Resolution No. 79-5; and <br />WHEREAS, those parties have now been served notice, as <br />required by statute, of the passage of Resolution 79-5; and <br />WHEREAS, the property described in Exhibit "A" is needed <br />for the public purpose of expansion of the current municipal complex <br />to provide for better and aditional municipal services; now, therefore <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. A fee simple interest in and to the parcel of <br />real estate described in Exhibit "A" be and the same hereby is <br />appropriated for municipal services, to wit: the expansion of the <br />current municipal complex so as to provide for better and additional <br />municipal services, pursuant to and in accordance with the Constitution <br />and laws of the State of Ohio. <br />Section 2. This Council finds that the appropriabion of <br />property made herein is necessary for said public purpose and that <br />the Village has been unable to agree with the owners of the property <br />on the purchase of the property appropriated herein. <br />Section 3. The Director of Law is hereby authorized and <br />directed to file a Complaint for Appropriation in a Court of competent <br />jurisdiction to have ajury impaneled to make inquiry into and assess <br />the compensation to be paid for the property described in Exhibit "A". <br />Section 4. Ordinance 79-76 is hereby repealed.
