<br /> <br />ORDINANCE NO. 79-87 <br />INTRODUCED BY: Mayor & Council as a Whole <br />AN ORDINANCE AMENDING SECTION 1119.16 OF <br />THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, <br />REPEALING EXISTING SECTION 1119.16 AND <br />DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 1119.16 of the Codified Ordinances of <br />Mayfield Village be and is hereby amended to read as follows: <br />1119.16 CERTIFICATION OF COMPLETION; MAINTENANCE BOND. <br />With respect to all improvements which have been <br />installed by the developer prior to the granting of <br />final approval of the subdivision, the Village Engineer <br />shall furnish to the Planning & Zoning Commission, at <br />the time that request is made for final approval, a <br />certification that all such improvements have been <br />constructed and installed according to the approved plans <br />therefor, and are ready for use and that they have been <br />approved by the various agencies whose approval is required. <br />In addition, the developer shall furnish to the Village <br />a Maintenance Bond in the amount of twenty-five percent (250) <br />of the cost of all improvements which have been installed. <br />This bond shall be conditioned on the proper operation of <br />these improvements for a period of three (3) years from the <br />date of the granting of the final approval. The Bond shall <br />provide that the Village will be held harmless and free of <br />tort and contract claims of third persons, with the right <br />given to the Village to ePfect any necessary repair or <br />correction of these improvements during such three (3) year <br />period and hold the principal and surety jointly and <br />severally liable on the bond. Before the Village exercises <br />its right to effect any necessary repairs or correction <br />to the required improvements during such:three (3) year <br />period it shall first qive a ten (10) day written notice <br />to the developer of its intention to do so. <br />Section 2. Existing Ordinance 1119.16 of the Codified <br />Ordinances of Mayfield Village is hereby repealed. <br />Section 3. This Ordinance is declared to be an emergency <br />measure immediately necessary for the preservation of the health, <br />safety and welfare of the residents of Mayfield Village in that it <br />provides a procedure for assuring the continued proper performance of <br />all required improvements in subdivision development.
