RESOLUTION N0. 79- 92 INTRODUCED BY: Mayor & Council as a Whole A RESOLUTION REQUESTING THE COUNTY AUDITOR TO ADVANCE TAXES FROM TAE PROCEEDS OF THE TAX LEVIES PURSUANT TO SECTION 321.34 OF THE OHIO REVISED CODE AND DECLARING AN EMERGENCY. WHEREAS, Section 321.34 of the Ohio Revised Code provides that any money in the Country Treasury in the account of Mayfield Village, Ohio, and lawfully applicable to the purpose of the current fiscal year may be drawn upon by request; now, therefore BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. The Auditor of Cuyahoga County, Ohio, be and he is hereby authorized to withdraw, and the County Treasurer of Cuyahoga County, Ohio be and.he is hereby authorized to deliver and pay over all monies in the Treasury of Cuyahoga County, Ohio due to Mayfield Village, Ohio, applicable to the purposes of the fiscal year and to deliver such monies to the Director of Finance of said Village as fiscal officer thereof, when and as such monies come into the hands of the Country Treasurer through the payment of taxes and assessments during the current fiscal year. Section 2. That the Clerk-Treasurer be, and she is, hereby authorized and directed to forward to the Auditor of Cuyahoga County, Ohio a certified copy of this Resolution. Section 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety £or the reason that its immediate Ixssage will enable the Village to obtain advances of monies enabling it to provide the necessary municipal services. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
