"(vi) Whenever the conditions giving rise to the establishment of the <br />National Highway Emergency Conservation Policy improve so that the <br />federal maximum highway speed limits are increased or rescinded, the <br />Council of the Village of Mayfield shall increase any maximum speed <br />limit that has been lowered under Section 19(g)(iv) of this Section <br />to the applicable maximum limit authorized by Section 4511.21 of the <br />Revised Code or to the applicable maximum limit authorized by <br />National policy, whichever is lower. <br />"(vii) When a speed in excess of the limit ofi Section 19(g)(i) of the Reuised <br />Code is alleged, the defendant shall be charged in a single Affidavit, <br />alleging a single act, with a violation indicated of both this Section <br />and Section 19(g)(iv) of Ordinance No. 810 of the Village of Pfayfield. <br />If the Court finds a violation of Section 19(g)(i) of the Ordinance <br />has occurred, it shall enter a judgment of conviction under such <br />Section and dismiss the charge under Section 19(g)(iv). If it finds <br />no violation of Section 19(g)(i) of the Ordinance, it shall then con- <br />sider whether the evidence supports a conviction under Section 19(g)(iv):' <br />Section 2. This Ordinance is hereby deemed to be an emergency measure, nec- <br />essary for the immediate preservation of the public peace, health, and safety of <br />the Village of Mayfield and its inhabitants. The reason. for such necessity lies <br />in the fact that the Federal Emergency Energy Conservation Act requires each state <br />to adopt locaer speed limits provided for in this Act no later than March 3, 1974 to <br />alleviate the effects of the energy crisis that has developed in this Nation. <br />Accordingly, the Village of Mayfield must adopt the lower speed limits which have <br />now been established by the State of Ohio.
