Ordinance No. 74- 24 <br />Introduced by: Mr. Prager <br />AN ORDINANCE DETERMINING TO PROCEED WITH PUBLIC IMPROVEMENT <br />OF AINTREE PARK DRIVE, HUNT CIRCLE, BEECHERS BROOK ROAD, <br />CHASE DRIVE, FOXBORO DRIVE, NORTABORO DRIVE AND DERBY <br />DRIVE BY THE INSTALLATION OF POST-TOP STREET LAIPS AND <br />DECLARING AN EMERGENCY <br />WHEREAS, this Council did adopt Resolution No. 859, on the 18th day of <br />March, 1974, declaring therein the necessity of the proposed improvement herein- <br />after described; and <br />WHEREAS, pursuant to said Resolution, estimated assessments with respect <br />to said improvement were duly prepared and placed on file in the office of the <br />Clerk-Treasurer; and <br />WHEREAS, due notice of the proposed improvement and estimated assessments <br />with respect to said improvement were served upon owners of the property to be <br />benefitted by certified mail; and <br />WHEREAS, no objection to said estimated assessments were filed thereby <br />avoiding the necessity of the appointment of an assessment equalization board; <br />NOW, THEREEORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, <br />CUYAHOGA COUNTY, OHIO, THAT: . <br />Section 1. It is hereby determined to proceed with the improvement of <br />Aintree Park Drive, Hunt Circle, Beechers Brook Road, Chase Drive, Foxboro Drive, <br />Northboro Drive and Derby Drive by the installation of post-top street lamps in <br />accordance with the provisions of said Resolution No. 859, and in accordance with <br />plans, profiles, specifications and the estimate of cost for said improvement here- <br />tofore approved and filed in the office of the Clerk Treasurer. <br />Section 2. That the estimated assessments of the cost of said improvement <br />heretofore prepared and filed in the office of said Clerk Treasurer be and the same <br />are hereby adopted. <br />Section 3. That it is further determined that the portion of the cost of <br />said improvement to be assessed against benefitted property shall be assessed in <br />the amount and manner and paid in annual installments as provided for in said <br />resolution declaring the necessity of said improvement. <br />Section 4. That no claims for damages resulting from said improvement have <br />been filed. <br />Section 5. This ordinance is declared to be an emergency measure necessary <br />for the immediate preservation of the public peace, health and safety of said <br />Village for the reason that said improvement is immediately necessary to properly
