Ordinance No. 74- 27 <br />Introduced by: Mr. Schulte <br />AN ORDINANCE TO REGULATE THE USE, STORAGE AND TRANSPORTATION <br />OF EXPLOSIVES FOR BLASTING PURPOSES AND PYROTECHNIC DISPLAYS <br />AND REPEALING ORDINANCE N0. 73-39 <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Section 1. It shall be unlawful for any person, firm or corporation to <br />blast with dynamite, gun powder or any other explosive compund, within the limits of <br />the Village of Mayfield, Ohio, unless there first shall have been issued a written <br />permit from the Village Engineer. Said permit shall set forth the conditions and <br />the circumstances under which said blasting may be done. The fee for such permit <br />shall be Ten ($10.00), and said permit shall be for such period as the Village <br />Engineer may designate, but not for over sixty (60) days; the permit may be <br />renewed by the Village Engineer for an additional period of sixty (60) days without <br />payment of additional fee. <br />Section 2. Before a permit to do blasting shall be issued, the applicant <br />for such permi.t shall file a liability insurance policy in the sum of One Hundred <br />Thousand Dollars ($100,000.00) for any one individual, and Three Hundred Thousand <br />Dollars ($300,000.00) for any accident, covering bodily injury, and wrongful death, <br />and in the amount of One Hundred Fifty Thousand Dollars ($150,000.00) insuring <br />against property damage of any nature caused by such blasting. Such policy shall <br />be approved by the Solicitor of the Village, and the policy or copy thereof shall <br />be filed with the Clerk-Tmasurer. Said policy shall name the Village of Mayfield <br />as an additional insured. <br />Section 3. The VillageE?gineer shall supply an Inspector who shall <br />observe all drilling, charging and shooting of all holes. The contractor shall <br />deposit with the Village of Mayfield funds to cover cost of inspection as <br />determined by the Village Engineer. Such funds to be maintained until completion <br />of work, any monies remaining to be refunded to contractor. <br />Section 4. Blasting operations shall not be conducted between the hours <br />of 7:00 o'clock p.m. and 7:00 o'clock a.m., nor at any time on Sundays except by <br />special permission of the Chief of Police. <br />Section 5. At least twenty-four (24) hours in advance of blasting, the <br />blaster shall give written notice specifying the location and intended time of <br />blasting to the appropriate representatives of the gas, electric, water, telephone, <br />telegraph and steam utilities which operate within the municipality. In an emergency <br />the Village Engineer may waive the time limit and allow verbal instead of written <br />notice to be given. <br />Section 6. Only electric blasting caps shall be used as the detonating <br />devices for blasting operations in congested districts, or on highways or adjacent <br />to highways open to traffic. <br />
