Ordinance No. 74- 28 <br />Introduced by: Mr. Bordonaro <br />AN ORDINANCE REGULATING THE DESTRUCTION AND REMOVAL <br />OF TREES WITHIN THE VILLAGE OF MAYFIELD, REPEALING <br />ORDINANCE N0. 72-12, AND DECLARING AN EMERGENCY. <br />WHEREAS, the destruction and removal of large numbers of trees <br />growing on premises in the Village of Mayfield is likely to result in undue <br />erosion of the soil, dust, pollution of the atmosphere, interference with the <br />natural water supply, drainiage problems, loss of oxygen, and unsightly and <br />blighted areas, and depressing of the value of the other property in the <br />community. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OE THE VILLAGE OF <br />MAYFIELD, CUYAHOGA COUNTY, OHIO, THAT: <br />Section 1. No person, firm, association or corporation shall, <br />in any one calendar year, remove or destroy or cause to remove or destroy, by <br />cutting, burning bulldozing, or any other means, more than 10 living trees having <br />a trunk diameter of 9 inches or more at height of 14 inches above the ground <br />level, or more than 25 percent of the living trees having such trunk diameter, <br />whichever is fewer, on any lot or parcel of land within the Village of Mayfield <br />without first filing an application for a permit for such purpose with the <br />Village Engineer and with the Building Inspector. <br />Section 2. Said application shall set forth the name and <br />address of each owner, lessee and person in possession of the lot or parcel <br />upon which said trees are situated; the name and address of each person who shall <br />be engaged in the destruction or removal of said trees; the statement as to whether <br />such work will be performed under a written or oral agreement or contract, to- <br />gether with a copy of the written agreement or contract or a statement of the <br />essential terms of the oral agreement or contract; a statement of the kind, <br />number and dimensions of the trees to be removed; and a legal description of each <br />lot or parcel, or in lieu thereof, a description of sufficient detail so that <br />such lot or parcel may be readily located on the plat map of the Village. <br />Section 3. Said application shall be forwarded to the Zoning <br />Board of Appeals of the Village of Mayfield by the Village Engineer and the <br />Building Inspector, within ten days after receipt thereof, together with their <br />report and recommendations thereon... <br />Section 4. The ZoningtBoard of Appeals shall set a date for hearing on <br />said application and shall notify in writing the applicant and any other persons <br />whom the Board deems to have an interest in the matter. Said hearing shall be held <br />within ten days after the report and recommendations of the Village Engineer and <br />Building Inspector are filed with the Zoning Board of Appeals. Written notice shall <br />be given to the applicant at least five days prior to the date of the hearing. The <br />Zoning Board of Appeals, after considering the reports and recommendations of the <br />Village Engineer and Building Inspector, as well as any and all additional evidence <br />presented by the applicant and other persons at said hearing, shall determine whether <br />
