<br />ORDINANCE N0. 74- 29 <br />Introduced by: Mrs. Negrelli <br />AN ORDINANCE REQUIRING OWNERS OF PROPERTY TO MAKE APPLICATION <br />FOR PERMIT FOR CONTRUCTION AND INSTALLATION OF SIDEWALKS <br />WITHIN THE PUBLIC RIGHT-OF-WAY AND ESTABLISHING A PERMIT FEE <br />THEREFOR, REPEALING ORDINANCE N0. 774 AND DECLARING AN <br />EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYHAHOGA <br />COUNTY, OHIO, THAT: <br />Section 1. An Application for a Permit shall be required for each <br />owner of property who shall construct or replace a sidewalk within the <br />public right-of-way. Said Application shall contain the name and address <br />of the applicant, a brief description of the work to be done, and the <br />approximate date of completion of said work. Said Application shall be filed <br />with the Building Inspector. <br />Section 2. A base permit fee of $10.00 plus $1.00 per 100 sq. ft. <br />shall accompany each application for permit as provided in Section 1 hereof. <br />Such permit shall cover the cost of two inspections of the work, the initial <br />inspection to be made after the forms are set and a final inspection to be <br />made upon completion of the work. <br />Section 3. Where it is determined by the Village Engineer or <br />by the Building Inspector that it is necessary to establish line and grade <br />settings, an additional fee shall be paid, said fee to be determined by the <br />Village Engineer based on work required by the Engineer at rates then in <br />effect for such work. This fee shall be in addition to the permit fee <br />as provided for in Section 2 hereof. <br />Section 4. Prior to the issuance of a permit by the Clerk Treasurer <br />the Building Inspector shall inspect the premises to be improved, shall determine <br />the grade level and location of said sidewalk, and shall provide the Applicant <br />with specifications for said work. The Building Inspector shall periodically <br />inspect the contruction of the sidewalk, and shall, upon its completion, <br />signify his acceptance of the work by written statement to the Clerk Treasurer. <br />Section 5. Ordinance No. 774 is hereby repealed as of the <br />effective date of this ordinance. <br />Section 6. This ordinance is hereby delcared to be an emergency <br />measure, necessary for the immediate preservation of the public peace, health, <br />safety and welfare of the Village of Mayfield, and for the further reason that <br />it is necessary to defray the cost and expenses of the Village with respect to <br />property owners' improvement of the public right-of-way and to control the <br />character of the improvement to be constructed, and this ordinance shall take <br />effect and be in force from and after the date of its passage. <br />Passed this 20th day , 74• <br />77?
