Ordinance No. 75- 3 <br />Introduced by: Mr. Barclay <br />AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF <br />A BOARD OF APPEALS AND DECLARING AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF DTAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. There is hereby established in the Village a Board of Appeals, <br />created to hear appeals for exceptions to, and variances in, the application of resolu- <br />tions, ordinances, regulations, building codes, measures and orders of administrative <br />officials or agencies governing zoning and building in a municipality in conformance <br />with Article V, Section 12(A) of the Charter of Mayfield Village. <br />Section 2. The Board of Appeals shall have no power or authority to grant any <br />change o£ or variance in any land use or clarification of district from the existing zoning <br />ordinances or the zoning map of the municipality, or to permit any land use to become non- <br />conforming therewith. In zoning for land use clarification districts for single family <br />residence purposes only, the Board of Appeals may grant changes or variances with respect <br />to restrictions on height of buildings or other structures, the size of parcels, and the <br />size, location and bulk of buildings and other structures, including percentage of 1ot <br />occupancy, set-back lines, and area of yards, courts and other open spaces, provided, <br />however, that no such changes or variances shall be granted by the Board of Appeals in <br />any other zoning or land use clarification or district. <br />Section 3. The Board of Appeals shall consist of five electors of the municipality. <br />Four of such members shall be appointed for terms of four years by the Mayor, subject to <br />confirmation by a vote of four members of Council; except that, of the four members <br />initially appointed for terms beginning January 1, 1975, one shall be appointed for a term <br />of one year, one for a term of two years, one for a term of three years, and one for a term <br />four years. The fifth member of the Board of Appeals shall be one of the five appointed <br />elector members of the Planning & Zoning Commission, who shall be elected annually to the <br />Board of Appeals by vote of at least four members of the Planning & Zoning Commission, <br />prior to or at such Commission's first meeting each year. Such fifth ciember of the Board <br />of Appeals shall serve for a term o£ one year, and shall be so elected by the Planning <br />& Zoning Coffinission each year. <br />Section 4. Council declares this to be an emergency ordinance necessary for the <br />preservation of the public peace, health and safety, such emergency arising out of the <br />necessity to comply with the Charter of 2fayfield Village, Article V, Section 12, requiring <br />Council to provide for a Board of Appeals; wherefore, this ordinance shall take effect and <br />be in force from and after its passage, and approval by the Mayor. <br />Passed: January 20th. , 1975. <br />ATTF.ST: <br />
