Ordinance No. 75-12 <br />Introduced by: Mr. Prager <br />AN ORDINANCE AMENDING ORDINANCE N0. 74-53 <br />PROVIDING FOR THE EMPLOYMENT OE WILLIAM T. <br />JACKMAN, P.E., AND DECLARING AN EMERGENCY <br />WHEREAS, Council deems it for the best interests of Mayfield Village to <br />employ a professional engineer to provide engineering services to improve to Manual <br />Standards and otherwise modernize certain locations on Wilson Mills Road from the <br />West Village Limits, east to S.R. 91. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Section 1. William T. Jackman, P.E., be and he is hereby employed as an <br />engineer to serve the Village in all matters relating to a project which encompasses <br />modernization of certain locations on Wilson Mills Road from the West City Limits, <br />east to S.R. 91. <br />Section 2. Compensation of the Engineer shall be based upon a percentage <br />of the construction cost calaulated at the rate of 12% o£ the first $100,000 and <br />71z% of the amount in excess of $100,000 construction cost for preliminary engineering, <br />final design and construction engineering. Payment for the completed services will <br />occur as work progresses in accordance with the following schedule indicating the pro- <br />ration of the fee based upon phases: <br />A. Preliminary Engineering - 50% of the total fee <br />B. Final Design - 40% of the total fee <br />C. Construction Engineering - 10% of the total fee. <br />Section 3. The,2iayor and Clerk Treasurer are hereby authorized and directed <br />to enter into a contract for engineering services with William T. Jackman, P.E., in <br />the form which has been approved by this Council and is attached to this Ordinance <br />as Exhibit A. <br />Section 4. This Ordinance is declared to be an emergency measure, necessary <br />for the iffinediate preservation of the public health, peace, safety and welfare of <br />the Village of Mayfield and its inhabitants, in order to provide necessary engineering <br />services to modernize certain locations on Wilson Mills Road, and this Ordinance shall <br />take effect immediately upon the date of i <br />Passed this /90"day of /????
