<br />Ordinance No. 76-12 <br />Introduced by: Mr. Grogan <br />AN ORDINANCE I,EVYING ASSESSMENTS FOR THE <br />IMPROVEMENT OF CERTAIN PUBLIC THOROUGHFARES <br />AND OTHER PUBLIC AREAS BY LIGHTING, AND FOR <br />MAINTINANCE AND OPERATION OE EXISTING LIGHTING <br />FACILITIES, AND DECLARING AN EMERGENCY <br />WHEREAS, a program of street lighting improvenents and other public area <br />lighting improvements has been instituted by Mayfield Village, and <br />WHEREAS, funds are required to continue said program and to maintain and <br />operate existing lighting facilities for the years 1977, 1978 and 1979. and <br />WHEREAS, a list of streets, public areas, lumen size and locations for such <br />lighting improvements, and a corresponding list of property owners to be assessed, <br />has been prepared and is on file in the office of the Clerk of the Village, and <br />WHEREAS, it is in the best interests of the citizens of Mayfield Village that <br />the street lighting and public lighting improvement program be continued. <br />BE IT THEREFORE ORDAINED BY TFIE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The assessment of the cost and expense of improving certain public <br />thoroughfares in the Village, and other public areas within said Village, by <br />lighting the same with sizes of lamps and at locations indicated on the plans <br />located in the Office of the Clerk, and of maintaining and oeprating existing street <br />lighting facilities in Mayfield Village in the aggregate amount of 1twenty-Five <br />Thousand Three Hundred Thirty-Four pollars and Fifty-Three Cents ($25,334.53) per <br />year for a period of three (3) years, as reported to'the Council by the Engineer <br />of this Village and also on file in the Of£ice of the Clerk of the Village should be <br />and the same is hereby adopted and confirmed and there are hereby levied and assessed <br />upon all lots and lands situated within the corporate limits of Mayfield Village, the <br />several amounts reported as aforesaid, which assessments are in direct proportion <br />to the tax value thereof, and are not in excess of the statutory limitations. <br />Section 2. This Council hereby determines that the said assessments which are <br />on file in the Office of the Clerk are in the same proportion to the estimated <br />assessments as originally filed as the cost of the above-described improvement is <br />to the estimated cost of the improvement as originally filed. <br />Section 3. The assessments against each lot or parcel of land shall be payable, <br />in cash, within ten (10) days after the date o£ the passage of this ordinance, or at <br />the option of the owner of such land, in one annual installment. A11 cash payments <br />shall be made to the Office of the Director of Einance of this Village, and all <br />assessments and installments remaining unpaid at the expiration of the said ten <br />(10) days shall be certified by the Clerk of this Village to the Auditor of Cuyahoga <br />County, Ohio, as provided by law, to be placed by hi,m on a tax duplicate and collected <br />accordingly. <br />I
