<br />AN ORDINANCE AMENDING CIiAPTER 513, "DRUG ABUSE CONTROL",
<br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, AND
<br />DECLARING AN EMERGENCY
<br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT:
<br />Section 1: Chapter 513, "Drug Abuse Control", is hereby amended in the
<br />following respects:
<br />513.01 De£initions.
<br />As used in this chapter, certain terms are defined as follows:
<br />(a) "Administer" means the direct application of a drug, whether by
<br />injection, inhalation, ingestion or any other means to a person
<br />or an animal.
<br />(b) "Controlled substance" means a drug, compound, mixture, preparation
<br />or substance included in Schedule I, II, III, IV, or V.
<br />(c) "Dispense" means sell, leave with, give away, dispose of or deliver.
<br />(d) "Hypodermic" means a hypodermic syringe or needle, or other instrument
<br />or device for the subcutaneous injection of inedication.
<br />(e) "Manufacturer" means a person who plants, cultivates, harvests, pro-
<br />cesses, makes, prepares or otherwise engages in any part o£ the production
<br />of a controlled substance by propagation, compoimding, conversion or
<br />processing, either directly or indirectly by extraction from substances
<br />of natural origin, or independently by means of chemical synthesis,or
<br />by a combination of extraction and chemical synthesis and includes any
<br />packaging or repackaging of the substance or labeling or relabeling of
<br />its container and other activities incident to production, except that
<br />this term does not include a pharmacist who prepares, compounds, pack-
<br />ages or labels a controlled substance as an incident to dispensing a
<br />controlled substance in accordance with a prescription and in the usual
<br />course of professional practice.
<br />(f) "Marihuana" means all parts of any plant of the genus cannabis, whether
<br />growing or not, the seed thereof; the resin extracted from any part of
<br />the plant; and every compound, manufacture, salt, derivative, mixture
<br />or preparation of the plant, its seeds or resin. It does not include the
<br />mature stalks of the plant, fiber produced from the stalks, oils or
<br />cake made from the seeds o£ the plant, any other compound, manufacture,
<br />salt, derivative, mixture or preparation of the mature stalks, except the
<br />resin extracted therefrom, fiber, oil or cake, or the sterilized seed
<br />of the plant which is incapable of germinization.
<br />(g) "Official written order" means an order written on a form provided for
<br />that purpose by the Director of the United States Drug Enforcement
<br />Administration, under any laws of the United States making provision
<br />therefor, if such order forms are authorized and required by federal law.
