-12- <br />8.11 No such use shall be expanded, changed, enlarged, or altered in a way <br />which increases its nonconformity. <br />8.12 No structural alteration, addition, or repair to any nonconforming <br />structure over the life o£ the structure shall exceed 50 percent o£ its value <br />at the time of its becoming a nonconforming use, unless the structure is <br />permanently changed to a conforming use. <br />8.13 If such use is discontinued for two years or more any £uture use of the <br />building premises shall conform to this Ordinance. The assessor shall notify <br />the Zoning Administrator in writing of instances of nonconforming uses which <br />have been discontinued for a period of one year. <br />8.14 If any noncon£orming use or structure is destroyed by any means, including <br />floods, to an extent o£ 50 percent or more of its assessed value, it shall not <br />be reconstructed except in con£ormity with the provisions of this Ordinance. <br />Provided that the Board of Appeals may permit reconstruction if the use or <br />structure is located outside the floodway and upon reconstruction, is <br />adequately and safely floodproofed, elevated, or otherwise protected in con- <br />formity with Section 7.35(1)-(5). <br />8.15 Uses of adjuncts thereof which are or become nuisances shall not be <br />entitled to continue as nonconfoxming uses. <br />8.16 Except as provided in Section 8.15, any use which has been permitted <br />as a Special Exception use shall be considered a conforming use. <br />8.17 Any alteration, addition, or repair to a nonconforming structure which <br />would substantially increase its flood damage potential shall be protected by <br />measures pursuant to Section 7.55(1)-(5) o£ this Ordinance. <br />8.18 The Building Commissioner stiall prepare a list of those nonconforming uses <br />which have been floodproofed or otherwise adequately protected in conformity <br />with Section 7.55(1)-(5). He shal 1 present such list to the Board of Appeals <br />which may issue a certificate to the owner stating that such uses, as a result <br />of these corrective measures, are in conformity with the provisions of this <br />Ordinance. <br />SECTION 9.0 PENALTIES FOR VIOLATION <br />Violation of the provisions of this Ordinance or failure to comply with any <br />of its requirements (including violations of conditions and safeguards established <br />in connection with grants of Variances or Special Exceptions) shall constitute a mis- <br />demeanor. Any person who violates this Ordinance or fails to comply with any of its <br />requirements shall upon conviction thereo£ be fined not more than $100.00 or imprisoned <br />for not more than 3 days, or both, and in addition, shall be considered a separate <br />offens e. <br />Nothing herein contained shall prevent the Council £rom taking such other lawful <br />action as is necessary to prevent or remedy any violation. <br />SECTION 10.0 AMENDMENTS <br />The regulations, restrictions, and boimdaries set forth in this Ordinance <br />
