Bordonar_Q_ <br />AN ORDINANCE AUTHOR22ING THE USE OF VILLAGE EQUIPMENT <br />TO PUMP OUT BASEMENTS IN PRIVATE RESIDENCES IN TIMES <br />OF UNUSUAL STORMS AND EMERGENCIES <br />WHEREAS, large quantities of water standing in basements of private <br />residences may constitute a menace to the public health and safety,and, <br />WHEREAS, Council considers it in the public interest to pump out flooded <br />basements in times of unusual storms and emergencies when Village equipment is <br />available for that purpose, and <br />i•]HEREAS, the Service and Fire Departments of the Village of Mayfield <br />have equipment which can be used for pumping out basements in times of emergencies, <br />provided such equipment is available and is not &eingcused for other Village <br />purposes. <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of <br />Mayfield, Cuyahoga County, Ohio, that: <br />Section 1. When basements in private residences are flooded in times <br />of unusual'storms and other emergencies, the Service Department is authorized to <br />use its equipment for pumping out basements in private residences, provided <br />that the Service Director in his discretion determines (a) that such an unusual <br />storm or emergency has caused such flooding and (b) that such equipment is not <br />needed at that time for other Village purposes. <br />Section 2. When the Service Department's equipment is not available <br />for pumping out basements in private residences in times of unusual storms and <br />emergencies, the Fire Department may use its equipment for such purpose, providing <br />the Fire Chief in his discretion makes: the same determinations as are required to <br />be made by the Service Director under the provisions of Section 1 of this Ordinance. <br />Section 3. Nothing contained in this Ordinance shall require the Village <br />to use its equipment for pumping out basements, and neither the Village nor any <br />official or employee thereof shall be liable in damages for failure to pump out a <br />basement or for any damage caused in performing such act. <br />Section 4.
