LEE CA <br />AN ORDINANCE REGULATING THE DESTRUCTION AND REt40VAL <br />OF TREES WITAIN TAE VILLAGE .OF HAYFIELD AND REPEALING <br />ORDINANCE N0, 70-42 <br />WHEREAS, the destruction and removal of large numbers of trees growing <br />on premises in the Village of Mayfield is likely to result in undue erosion of <br />the soil, dust, pollution of the atmosphere, interference with the natural water <br />supply, drainage problems, loss of oxygen, and unsightly and blighted areas, and <br />depressing of the value of other property in the community, <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, that: <br />Section 1. No person, firm, association or corporation shall, in any one <br />calendar year, remove or destroy or cause to remove or destroy, by cutting, burning, <br />bulldozing, or any other means, more than 10 trees having a trunk diameter of 9 <br />inches or more at height of 14 inches above the ground level, or more than <br />25 percent of the living trees having such trunk diameter, whichever is fewer, on <br />any lot or parcel of land within the Village of Mayfield without first filing an <br />application for a permit for such purpose with the Village Engineer and with <br />the Building Inspector. <br />Section 2. Said application shall set forth the name and address of <br />each owner, lessee and person in possession of the lot or parcel upon which said <br />trees are situated; the name and address of each person who shall be engaged in <br />the destruction or removal of said trees; the statement as to whether such work <br />will be performed under a written or oral agreement or contract, together with <br />a copy of the written agreement or contract or a statement of the essential <br />terms of the oral agreement or contract; a statement of the kind, number and <br />dimensions of the trees to be removed; and a legal description of each lot or <br />parcel, or in lieu thereof, a description of sufficient-detail so that such lot <br />or parcel may be readily located on the plat map of the Village. <br />Section 3. Said application shall be forwarded to the Zoning Board of <br />Appeals of the Village of hayfield by the Village Engineer and Building Inspector, <br />within ten days after receipt thereof, together with their report and recom- <br />mendations thereon. <br />Section 4. The Zoning Board of Appeals shall set a date for hearing on <br />said application and shall notify in writing the applicant and any other persons <br />whom the Board deems to have an interest in the matter. Said hearing shall be <br />held within ten days after the report and recommendations of the Village Engineer <br />and Building Inspector are filed with the Zoning Board of Appeals. Sdritten notice <br />shall be given to the applicant at least five days prior to the date of the <br />hearing. The Zoning Board of Appeals, after considering the reports and recom- <br />mendations of the Village Engineer and Building Inspector, as well as any aad all <br />additional evidence presented by the applicant and other persons at said hearing, <br />
