. '' <br /> <br />by the Village shall not, at the election of the Council, <br />continue for a succeeding year. If the Village Council shall <br />determine that such organization is ready and able to main- <br />tain said common property in reasonable condition, the <br />Village shall cease to maintain said common property at the <br />end of said year. If the Council shall determine such organiza- <br />tion is not ready and able to maintain said common property <br />in a reasonable condition, the Village may, in the discretion <br />of the Village Council, continue to maintain said common <br />property during the next succeeding year and subject to a <br />similar hearing and determination, in each year thereafter. <br />The decision of the Village Council in any such case shall <br />constitute a final administrative decision subject to judicial <br />review. <br />(f) The cost of such maintenance by the Village as set <br />forth in (e) above shall be assessed ratably against the <br />properties that have a right of enjoyment of said property <br />commonly owned and shall become a tax lien on said properties. <br />The Village Solicitor, at the time of entering upon said <br />common property for the purpose of improvements and maintenance, <br />shall file a notice of such lien in the office of the Cuyahoga <br />County Recorder upon the properties affected. <br />_ Section 16. Amendments to this Ordinance. <br />This ordinance may be amended in the manner provided in <br />Section of Chapter (As in the case of other <br />amendments to the Zoning Ordinance.) <br />-40- <br />I <br />
