<br />ORDINANCE NO. 73- 9 <br />Introduced by: Mr. Davis <br />AN ORDIDIAIQCE TO AMEND ORDINANCE NO. 309, <br />BEING AN ORDINANCE TO REGULATE TRAFFIC <br />ON THE STREETS AND PUBLIC HIGHWAYS OF THE <br />VILLAGE OF HAYFIELD, BY AMENDING SECTION <br />19 (g) PERTAINING TO SPEED REGULATIONS <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />COUNTY OF CUYAHOGA, STATE OF OHIO THAT: <br />Sec. 1. Section 19(g) of Ordinance No. 309, being an <br />Ordinance to regulate traffic on the public streets and highways in <br />the Village of Payfield, is hereby amended to read as follows: <br />"(g) Sixty miles per hour at all times on freeways <br />with paved shoulders except for the operators of trucks and commercial <br />tractors weighing in excess of four thousand pounds empty weight and <br />school busses which shall be fifty miles per hour at all times. <br />It is hereby determined upon the basis of an engineering <br />and traffic investigation that the minimum speed for safe operation of <br />vehicles on freeways with paved shoulders is forty miles per hour which <br />minimum speed as declared shall be effective when signs are erected <br />giving notice thereof. <br />It shall be prima-facie unlawful for any person to exceed <br />any of the maximum speed limitations or operate a vehicle at a speed <br />below the minimum speed set forth in this section. In every charge of <br />violation of this section the Affidavit and Warrant shall specify the <br />time, place, and the speed at which the Defendant is alleged to have <br />driven, and also the .speed which this section declares shall be prima- <br />facie lawful at the time and place of such alleged violation. <br />Whenever the director of highways of the State of Ohio, <br />in accordance with Section 4511.21 of the Ohio Revised Code, determines <br />a reasonable and prima-facie speed limit which is different from any <br />such limit as set forth in this section, such speed limit so established <br />by the Director of Highways shall be effective in the Village of Mayfield <br />provided appropriate signs are posted giving notice of such different <br />limitations." <br />Sec. 2. This ordinance is hereby declared to be an emergency <br />measure, necessary for the immediate preservation of the public safety, <br />peace, health and welfare of the Village of Mayfield and its inhabitants, <br />in order to provide laws which, when in force, will prevent accidents <br />on the public highways, and said ordinance shall therefore be in full <br />force and effect from and after the date of its passage. <br />Passed thisl9th day of Feb 1973. <br />ATTEST: <br />~~ <br />(S A ) CLERK-TREASURER <br />~~f/'~'~ <br />' YOR - PRESIDENT OF COUNCIL <br />
