<br />AN ORDINANCE REPEALING ORDINANCES NO. 349 AND
<br />NO. 362 AND ENACTING ORDINANCE N0. 73-19
<br />PROHIBITING LITTERING AND THE DEPOSIT OF
<br />GARAGE, RUBBISH, REFUSE AND FILL UPON PUBLIC
<br />OR PRIVATE PROPERTY
<br />4JHEREAS, this Ordinance constitutes an emergency measure for
<br />the immediate preservation of the public peace, property and safety and
<br />Eby reason of the emergency which exists, the Village of Mayfield deems
<br />it a matter of great urgency to enact legislation prohibiting littering
<br />and the deposit of garbage, rubbish, refuse and fill upon public or
<br />private property within the Village of Mayfield.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
<br />OF HAYFIELD, OHIO:
<br />Sec. 1. That Ordinance No. 349 and Ordinance No. 362 of the
<br />Ordinances of the Village of Mayfield, Ohio, be aid the same are hereby
<br />repealed.
<br />Sec. 2. That the following Ordinance, known as Ordinance
<br />No. 73- 19, of the Ordinances of the Village of Mayfield, Ohio, be and
<br />the same is hereby enacted.
<br />A. DEFINITIONS: GARBAGE, RUBBISH, REFUSE, FILL
<br />For the purposes of the Ordinance, the following terms,
<br />words, and their derivations shall have the meaning given herein.
<br />Not inconsistent with the context, words used in the present tense
<br />include the future; words used in the plural number include the
<br />singular number; and words used in the singular number include the
<br />plural number.
<br />(1) "Garbage" means putrescible animal and vegetable
<br />waste resulting from the handling, preparation, cooking and
<br />consumption of foods.
<br />(2) "Rubbish" shall mean all nonputrescible, combustible,
<br />and non combustible solid wastes, including paper wrapping,
<br />cardboard, metallic, and plastic containers, yard clippings,
<br />leaves, woods, glass, building materials, market and indus-
<br />trial wastes, tree stumps, tree limbs and logs, bedding,
<br />appliances, toys, abandoned automobiles.
<br />(3) "Refuse" shall mean all putrescible and nonputres-
<br />cible, combustible and non combustible solid wastes other
<br />than garbage and rubbish.
<br />(4) Except as otherwise provided in Sec. 2(B)(2) herein,
<br />"fill" shall mean the use of garbage, rubbish, refuse, soil,
<br />dirt or any combination of the foregoing which are placed
<br />upon any public or private land within the Village of Mayfield.
