ORDINANCE ~f73-41 <br />Introduced by: Mr. Davis <br />AN ORDINANCE TO AMEND SECTION 111.1304 OF SECTION 1 OF <br />ORDINANCE 1I102, KNOWN AS THE INCOME TAX ORDINANCE BY <br />PROVIDING THAT IF THE ESTIMATED TAX IS NOT MORE THAN TEN <br />DOLLARS ($10.00), NO DECLARATION OR PAYMENT IS REQUIRED <br />AND BY AMENDING SECTION 111.1306 OF SECTION 1 PROVIDING <br />FOR PAYMENT OF THE DECLARATION OF ESTIMATED TAX <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT: <br />Section 1. Section 111.1304 of Section 1 of Ordinance No. 1021, the Income <br />Tax Ordinance, is hereby amended to read as follows: <br />"Section 111.1304. Filing of Declaration. <br />"(1) The declaration required by Section 111.1303 above <br />shall be filed on or before April 30 of each year during <br />the effective period set forth in Section 111.0502 or within <br />four months of the date the taxpayer becomes subject to tax <br />for the first time. <br />"Except as provided in this section, every person shall file <br />a declaration setting forth taxable income, including dis- <br />tributive shares of net profits of unincorporated business <br />entities, estimated to be earned during the current tax year, <br />together with the estimated tax due thereon, less the amount <br />withheld within the Village of Mayfield and less the tax <br />credit allowed in Chapter 19 hereof, unless the entire <br />taxable income is subject to withholding within the Village of <br />Mayfield as provided in this Income Tax Ordinance. If the <br />estimated tax for the current year, less the tax to be withheld <br />and less such tax credit, amounts to not more than $10.00, <br />no declaration or payment of estimated tax is required." <br />Section 2. Section 111.1306 of Section 1 of Ordinance No. 1021, the Income <br />Tax Ordinance, is hereby amended to read as follows: <br />"Section 111.1306. Payment to Accompany Declaration. <br />"Such declaration of estimated tax to be paid to the Village of <br />Mayfield shall be accompanied by a payment of at least one-fourth <br />(1/4th) of the estimated annual tax and at least a similar amount <br />shall be paid on or before the last day of the seventh (7th) and <br />tenth (10th) months after the beginning of the taxable year, and <br />on or before the last day of the first (1st) month of the suc- <br />ceeding year following the taxable year. Provided, however, that <br />in case an amended declaration has been filed, the unpaid balance <br />shown due thereon shall be paid in equal installments on or before <br />the remaining payment dates." <br />
