<br />J <br />ORDINANCE N0. 1052 <br />By: Mr. Davis <br />AN EMERGENCY ORDINANCE ENACTED BY THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, <br />OHIO, ZN THE MATTER OF THE HEREINAFTER DESCRIBED IMPROVEMENT, UNDER TIIE SUPERVISION <br />OF THE DIRECTOR OF HIGHWAYS. <br />WHEREAS, the Director of Highways is considering improving a portion of <br />the public highway which is described as follows: The improvement of SR-91, Sections <br />12,89, 13,29 and 15,36, known locally as SOM Center Road, by resurfacing length and <br />width of existing pavement by placing a 1" 403 asphalt concrete intermediate course <br />and a 1" 404 asphalt concrete surface course; placing 617 berm material 3' wide and <br />approximately 2" thick; adjusting castings to conform with grade of completed im- <br />provement. Length of project - 13,142 linear feet or 2,49 miles; width - 20' and <br />variable. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />OHIO: <br />Section 1, Consent: That it is declared to be in the public interest <br />that the consent of said Village be, and such consent is, hereby given to the <br />Director of Highways, to construct the above-described improvement, in accordance <br />with plans, specifications and estimates, as approved by the Director. <br />Section 2. Cooperation: That said Village hereby proposes to cooperate <br />with the State of Ohio, in the cost of the above-described improvement as follows: <br />The amount of participation (the lump sum of $372.00, which will include the cost <br />of adjusting utility castings to grade.) This will include the total of Item 4 of <br />Form CS-6 and the amount noted in Item 4 of CS-13, <br />Section 3, Authority to Sign: That the Clerk-Treasurer of said Village <br />is hereby authorized to enter into maintenance and parking agreements and special <br />contractual obligations. <br />Section 4. Maintenance and Parking: That upon completion of said im- <br />provement, said Village, will thereafter keep said highway open to traffic at all <br />times, and: <br />(a) Paintain the improvement in accordance with the provisions of the <br />statutes relating thereto and make ample financial and other provisions for such <br />maintenance; and <br />(b) Maintain the right-of-way and keep it free of obstructions in a man- <br />ner satisfactory to the State of Ohio, and hold said right-of-way inviolate for <br />public highway purposes and permit no signs, posters, billboards, roadside stands <br />or other private installations within the right-of-way limits; and <br />(c) Regulate parking in the following manner: No parking at any time, <br />Section 5. Traffic Control Signals and Devices: That traffic control <br />signals will not be installed on the project without prior approval by the State <br />and the Village will place and maintain all traffic control devices conforming to <br />the Ohio Manual of Uniform Traffic Control Devices on the improvement in compliance <br />with the provisions of Section 4511,11 and related Sections of the Ohio Revised <br />Code, <br />
