SCHMIDT <br />AN ORDINANCE TO SUPPLEMENT ORDINANCE N0. 705, ENTITLED: <br />"AN ORDINANCE TO APiEND THE ZONING ORDINANCE OF THE VILLAGE <br />OF PAYFIELD BY TRANSFERRING CERTAIN PROPERTY ON THE WEST <br />SIDE OF SOM CENTER ROAD TO A CLASS U-3 USE DISTRICT (APART- <br />MENT HOUSE)" BY PERMITTING TO A LIMITED EXTENT THE CONSTRUCT- <br />ION OF APARTMENT HOUSES NOT MORE THAN EIGHT STORIES IN HEIGHT <br />IN A CERTAIN PORTION OF SAID PROPERTY. <br />WHEREAS, Council finds that it will promote the public health, peace, <br />safety, comfort, prosperity, convenience and general welfare, to amend the <br />Zoning Ordinance of the Village of Mayfield in the manner hereinafter provided, <br />and will not substantially injure any property in the Village or the use thereof; <br />and <br />IdIlEREAS, Council finds that this amending Ordinance has been submitted <br />to the Village Planning ,and Zoning Commission for approval, disapproval, or sug- <br />gestion, and that said Commission has allowed a reasonable time for consideration <br />and report, and has approved the same in the form herein set forth, and that a' <br />public hearing has been had thereon, and notice of such hearing given in the <br />manner provided by lacy. <br />--... NOid, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />COUNTY OF CUYAHOGA AND THE STATE OF OHIO, THAT: <br />~, Section 1. Subject to the conditions hereinafter set forth, an apart- <br />ment house building, not more than eight stories in height, including penthouse, <br />may be constructed on the following described property, crhich is a portion of <br />i the property described in Ordinance No. 705, entitled: "An Ordinance to Amend the <br />Zoning Ordinance of the Village of Mayfield, by Transferring Certain Property on <br />the West Side of SOM Center Road to a Class U-3 Use District (Apartment House)": <br />"Situated in the Village of Mayfield, County of <br />i Cuyahoga and State of Ohio, having a frontage on the West Side of SOM <br />Center Road, beginning at the common corporate line of the Village of <br />~ Mayfield and the City of Mayfield Heights, and extending Northerly a <br />distance of 1100 feet, and extending back of equal distance to a depth <br />of 350 feet idest of the center line of SOPi Center Road." <br />Provided, however, that not more than 146 apartment suites shall be constructed <br />on the premises described in the next preceding paragraph hereof, and that a total <br />of not more than 336 apartment suites shall be constructed on the entire premises <br />described in said Ordinance No. 705, and further provided that the construction <br />of said suites shall in all•xespects conform to the provisions of the Ordinance <br />of the Village of Mayfield pertaining to same. It is further provided that the <br />number of buildings over two stories in height shall be limited to one L-shaped <br />building. <br />
