V (2) but not poured, the builder or owner shall again give at least 24 hours notice for a final inspection of the grade by the Engineer. The Engineer shall then give the Building Inspector a report in writing, and no building permit shall be issued until the provisions of this Ordinance have been complied with. Section 5. Any person, firm, partnership, corporation or voluntary association of persons who shall commence the construction of the structure without first having obtained the grade therefor, in accordance with the pro- visions of this Ordinance, and anyone constructing a structure at a grade other than that prescribed or agreed. to by the Engineer, or on appeal by the Architec- tural Board of Review or Council, or who shall perform substantial grading in- cidental to an open land use of the premises, without obtaining the proper grade or a grade other than prescribed, shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than $500.00, or committed to jail for more than ten days, or both, and shall stand committed until :such fine is paid. In addition, the Building Inspector may stop the work, and all remedies prescribed by Ordinances Nos. 465 and 726, and amendments thereto, shall be available in the event of violation of this Ordinance. Section 6. This Ordinance is hereby declared to be an emergency measure, necessary for the immediate preservation of the public peace, health, safety and welfare of the Village of Mayfield and its inhabitants, for the reason that it is necessary to insure the proper setting of grades for new construction in order to prevent damage to property, including properties of other land owners, and this Ordinance shall be in full force and effect from and after the date of its passage.
