~~ ORDINANCE N0. 1073' BY: MR. Davis AN ORDINANCE AUTHORIZING THE CONSTRUCTION OF A WATER NY~IN IPI WILSON PiILLS ROAD BY DR. EUGENE EDSdARD ACKLEY,, THERESA ACKLEY AND JOHN PUSTAI. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, COUNTY OF CUYAHOGA, OHIO, THAT: Section-1, Council hereby authorizes Dr. Eugene Edward Ackley and Theresa Ackley, husband and wife, and John Pustai to have constructed a 12- inch water main in Wilson Mills Road, starting at the Easterly end of the existing water main opposite the property at 7105 Wilson Mills Road, acd extend- ing Easterly approximately 220 feet. Said water main is to be constructed by a contractor to be approved by the Village Engineer and shall be constructed ac- cording to the rules and regulations of the water department of the City of Cleveland, Ohio, in accordance with the plan hitherto approved by said water department, and to be approved by. the Village Engineer, and subject to the approval of an inspector for the Village of Mayfield. In connection with the contract for construction of said water main, there shall be deposited with the Clerk-Treasurer of the Village of Mayfield, a policy (or copy or certificate thereof) of liability insurance,- insuring against bodily injury liability and wrongful death liability in the amount of $100,000.00 for each person and for each accident, and property damage liability in the amount of $5,000,00, in connection with the work to be done under said construction contract. Said contract shall also be accompanied by a cash performance bold or a surety performance bond in form to be approved by the Village Solicitor, in the amount of the contract price, guaranteeing performance of said contract and payment of all claims for labor and materials furnished in connection therewith. In the event the contractor does not complete performance of the contract, the above-named Dr. Eugene Edward Ackley, Theresa Ackley and John Pustai shall complete the same, and if they fail to complete the performance of the contract, the Village of Mayfield shall have the right to complete construction and to look to the said persons, the contractor, and the company executing the security bond for reimbursement thereof, Before commencing construction of said water main, the said Dr. Eugene Edward.Ackley, Theresa Ackley and John Pustai, shall comply with the provisions of Ordinance No. -979, passed November 21, 1966, by paying to Arthur D. George, Geneva L, George, and Mary Parziale, the owners of the premises at 7105 Wilson Mills Road, the proportion of the cost of'the construction of the portion of the water main crossing Echo Drlve (as calculated by the Village Engineer) and as described in said Ordinance No. 979. Section 2. The said Dr. Eugene Edward Ackley, Theresa Ackley and John Pustai shall pay all engineering costs in connection with the i~tallation of said water main,
