Schmidt <br />AN ORDINANCE AUTHORIZING THE PIAYOR TO PROCLA71~i EXISTENCE <br />OF CIVIL EMERGENCY; AUTHORIZING TIIE MAYOR TO IMPOSE CURFEW <br />DURING CIVIL EMERGENCY; AUTHORIZING THE MAYOR TO REGULATE <br />THE CONDUCT OF CERTAIN BUSINESSES DURING CIVIL IaSERGENCY; <br />PRESCRIBING PENALTY FOR VIOLATION, AND PROVIDING THAT THIS <br />ORDINANCE SHALL BE AN f:PfERGENCY MEASURE. <br />WHEREAS, under the Revised Code of the State of Ohio, the Mayor of <br />this Village is the Chief Executive Officer thereof, and is made responsible <br />for the enforcement of all laws of said Village; and <br />WHEREAS, it is deemed necessary and in the public interest that the <br />Village take all appropriate act=ion to insure that orderly procedures exist to <br />protect persons and property of i:he citizens of the Village of Mayfield. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAY- <br />FIELD, CUYAHOGA COUNTY, OHIO; TfL1T: <br />Section 1. Definition.,: <br />1. A Civil Emergency is hereby defined to be: <br />a. A riot or unlawful assembly characterized by the use of <br />force or violence or any threat to use such force by three or more persons <br />acting together without the authority of law. <br />b. Any natural disaster or manmade calamity, including flood, <br />conflagration, cyclone, tornado, earthquake or explosion within the corporate <br />limits of the Village of Mayfield, resulting or reasonably expected to result <br />in the death or injury of persons or the destruction of property to such an <br />extent that extra ordinary measures must be taken to protect the public health, <br />safety and welfare. <br />2. Curfew is hereby defined as a prohibition against any person or <br />persons walking, running, loitering, standing or motoring upon any alley, <br />street, highway, public property or vacant premises within the corporate limits <br />of the Village of Mayfield, excepting persons officially designated to duty <br />with reference to said civil emergency. <br />Section 2. Powers of Mayor: Whenever, in the judgment of the Mayor, <br />or acting Mayor, a state of civil emergency exists as a result of mob action, <br />riots, general civil disobedience or disorder, or the threat of any of the <br />same shall exist, the Mayor or acting Mayor shall, in addition to all other <br />powers granted him by the laws of this state and the Ordinances of the Village, <br />be empowered in order to suppress such actions and preserve the peace and order <br />of the Village and to protect its citizens and their property,to issue a <br />proclamation declaring a state of civil emergency to exist, and may thereby <br />exercise the powers granted in the following subsections: <br /> <br />
