~G <br />Ordinance No7,nR3 (4) <br />1 <br />~ Section 7. Permit to be in Tcac Parts. <br />(a) The first part of the permit shall grant permission only to excavate <br />and build a neca foundation to receive the building or structure which is to, be <br />moved. <br />(b) The second part of the permit shall grant permission to move the <br />building or structure only after the excavation and foundation have been completed <br />to the point bf receiving the building or structure and have been approved by the <br />Building Inspector. <br />Section S. Time Limit of Permit. The permit shall be invalid unless <br />the building or structure is completely set upon the foundation within 60 days <br />after the excavation has been completed; provided, hocaever, that the Building <br />Inspector may grant extensions in writing for periods not exceeding thirty (30) <br />days each. <br />Section 9. Penalties. Any person who shall move any building or <br />structure or substantial part thereof without obtaining a permit therefor, or <br />without complying with the terms of this Ordinance as to furnishing a cash deposit <br />or liability insurance, or notice.to certain property owners, or approval of the <br />Architectural Board of Review, shall be guilty of a misdemeanor, and upon con- <br />viction thereof, shall be fined not more than $500.00, or stand committed until <br />the fine is paid, and each daycs violation, hocaever, shall constitute a separate <br />offense, <br />Section 10, Action by Village Solicitor. The Village Solicitor is <br />hereby authorized to take action to enjoin the violation of this Ordinance and <br />to recover damages suffered by the Village because of any violation of this <br />Ordinance, and to take action to enforce the conditions of the cash bond provided <br />for in ,this Ordinance. <br />Section 11. Ordinance No. 734, entitled "An Ordinance Requiring a Cash <br />;Bond, Liability Insurance, Approval of Architectural Board of Review, and Notice <br />to Certain Property Owners, for Pioving, Removing, or Demolition of Buildings, <br />Structures or Substantial Parts Thereof, and Providing Penalties and Remedies for <br />Violation Thereof," passed February 20, 1961, is hereby repealed as of the ef- <br />fective date of this Ordinance. <br />Section 12. Emergency. This Ordinance is deemed to be an emergency <br />measure, necessary for the immediate preservation of the public peace, health, <br />safety and welfare, in order to prevent damage to the public roads and highways, <br />and injuries to persons using the same, as well as damage to private property <br />abutting the highways, and this Ordinance shall be in force and effect from and <br />after the date of its passage. <br />Passed this 20th day of January , 196. <br />ATTEST: PtA - PRESI 'NT OF COUNCIL <br />~ ~ ~~ <br />(SEAL) CLERK-TREASURER <br /> <br />
