Davis <br />AN ORDLVANCE LEVYIiJG SPECIAL ASSESSMENTS FOR THE IPII'ROVEMENT <br />OF WORTON PARK DRIVE, IIQ THE VILLAGE OF HAYFIELD, BET[~7EEN <br />CERTAIN TERMINI, EY GRADING fu~iD PAVING WITH ASPHALTIC PIATERIALS, <br />TOGETHER WITH ALL NECESSARY APPURTENANCES. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY, STATE OF OHIO, THAT: <br />Section 1. That the revised assessments of the cost and expense of <br />tiie improvement of Worton Park Drive, in the Village of Hayfield, Ohio, from <br />idilson Mills Road to Hemingcaay Road, by grading and paving with asphaltic con- <br />crete materials, together with all necessary appurtenances, amounting in the <br />aggregate to II 17,883.00. <br />as reported to this Council of the 16th day of December, 1968, by the Engineer <br />of this Village, and nozv on file in the office of the Clerk-Treasurer of the <br />Council, be, and the same is, hereby adopted and confirmed, and that there be, <br />and hereby are, levied and assessed upon the lots and lands abutting upon said <br />improvement, the several amounts reported as aforesaid, which assessments are <br />in proportion to special benefits and are not in excess of any statutory <br />limitation. <br />Section 2. That this Counc~,l hereby finds and determines that the <br />revised assessments as nocv on file in the office of said Clerk-Treasurer are <br />in the same proportion to the estimated assessments as originally filed as the <br />actual cost of the above-described improvement is._to the estimated cost of the <br />improvement as originally filed. <br />Section 3. That the assessment against each lot or parcel of land <br />shall be payable in cash within 30 days after the passage of this Ordinance or <br />at the option of the oomer in 10 annual installments with interest, at the same <br />rate as shall be borne by bonds to be issued in anticipation of the collection <br />of the same. All cash payments shall be made to the Treasurer of this Village. <br />All assessments and installments thereof remaining unpaid at the expiration of <br />said 30 days shall be certified by'the Clerk-Treasurer of this Council to the <br />County Auditor as provided by law to be placed by him on the tax duplicate and <br />collected as other taxes are collected. <br />Section 4. That the Clerk-Treasurer of this Council shall cause a <br />Notice of Passage of this Ordinance to be published once in a newspaper of <br />general circulation in this Village, and to continue on file in his office said <br />revised assessments. <br />Section 5. The Clerk-Treasurer of this Council is hereby directed <br />to deliver a certified copy of this Ordinance to the County Auditor within 20 <br />days after its passage. <br />~`~ <br /> <br />
