Crhmiri+ <br />AN ORDINANCE PROHIBITING THE PURCHASE, USE OR POSSESSION OF <br />LYSERGIC ACID DIETHYLAMIDE (LSD). <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY; OHIO, THAT: <br />Section 1. Purchase, Use or 'Possession of 'LSD and Other <br />Hallucino¢ens. As used in this Section, "hallucinogen" means d-lysergic acid <br />diethylamide, commonly known as LSD; N-N-diethyltrptamine, commonly known as <br />DMT; psilocybin, mescaline, peyote, bufotenin, epena, parica, ayahuasca, gage, <br />caapi, amanita muscaria, and any other compound, mixture, preparation or <br />substance which produces hallucinations or illusions when introduced into the <br />body. (ORC 3719.40.) <br />Section 2. No person shall, with intent to produce hallucinations <br />or illusions, purchase, use, possess or have under his control a hallucinogen. <br />Possession or control of any hallucinogen specifically named in Section 1 here- <br />of constitutes prima-facie evidence of a violation of this Section, except that <br />this Section does not apply to the use, possession or control of any hallucinogen <br />by licensed manufacturers, wholesalers, pharmacists, owners of pharmacies, <br />physicians and other persons for research., clinical or medicinal purposes <br />authorized by Federal Law or any rules or regulations adopted pursuant thereto. <br />(ORC 3719.41.) <br />Section 3. Whoever violates any of the provisions of this Ordinance <br />shall be fined not more than $1,000.00 or imprisoned not more than one year, <br />or both. <br />Section 4. This Ordinance is hereby declared to be an emergency <br />measure, necessary for the immediate preservation of the public peace, health, <br />safety and welfare and for the further reason that it is immediately necessary <br />to safeguard the health of persons in this community; and this Ordinance shall <br />be in full force and effect from and after the date of its passage. <br />Passed this ~ day of /7RRC./-! 1969. <br />~~~i ~ ' 1~/lid <br />ATTEST: MAYOR PRES ~E T OF COUNCIL <br />~V ~T/ <br />(SEAL) CLERK-TREASURER <br />
