i;3 <br />(3) <br />Industrial Commission of Ohio applicable thereto, which provisions are made a <br />part of this Ordinance. <br />Section 18. Nothing in this Ordinance shall be construed as applying <br />to the regular military or naval forces of the United States, the authorized <br />militia of this state, or to the members of the Police, and Fire Departments in <br />the proper performance of their duty. <br />Section 19. The Chief of Police shall make such rules and regulations <br />to have the force and effect of law, which may be required to facilitate the <br />administration and enforcement of the provisions of this Ordinance to provide <br />safety to life and limb of persons and the preservation of property. The rules <br />and regulations formulated by the Chief of Police shall be published, and a <br />copy filed with the Clerk-Treasurer, and the same are hereby adopted and in- <br />corporated herein as if set out at length herein, and from the effective date of <br />this Ordinance, the provisions thereof shall be controlling within the limits <br />of the Village of Mayfield, Ohio. Wherever the words "Safety Director" or <br />"Director of Safety" appear in the rules and regulations formulated by the <br />Chief of Police, and filed with the Clerk-Treasurer, such words shall deem to <br />mean "Chief of Police of the Village of Mayfield." <br />Section 20. Pyrotechnics. <br />(a) The term "pyrotechnics," whenever used in this <br />Ordinance, shall be held to mean any sprinkler, Squibb, rocker, firecracker, <br />roman candle, fire ballon, railroad track torpedo, flashlight composition, <br />fireworks, or other device or composition used to obtain visible or audible <br />pyrotechnic display. <br />(b) It shall be unlawful for any person to have, keep, <br />store, use, manufacture, sell, handle, transport, or otherwise dispose of any <br />pyrotechnic within the limits of the Village of Mayfield; provided, however, <br />that the Fire Chief, upon proper application made, may issue a permit to a <br />properly qualified person or organization for giving a pyrotechnic display of <br />fireworks in public parks or other public places. Such permits shall impose <br />such restrictions as in the opinion of the Fire Chief may be necessary to <br />safeguard life and property. <br />Section 21. Any person who shall violate any of the provisions of <br />this Ordinance or fail to comply therewith any rules or order made thereunder, <br />or who shall act in violation of any detail statement of specifications or <br />plans submitted or approved thereunder, or any certificate or permit .issued <br />thereunder, shall serverally, for each and every such violation and non- <br />compliance, be fined not less than Fifty Dollars ($50.00), nor more than <br />,Five Hundred Dollars ($500.00), and each day that prohibited conditions are <br />maintained shall constitute a separate offense, and shall stand committed until <br />payment thereof. The imposition of one penalty for any violation shall not <br />excuse the violation or permit it to continue, and all such persons shall be <br />required to correct or remedy such violation of defects within a reasonable <br />time fixed by the Chief of Police. <br />J <br />
