i _i <br />ORDINANCE N0. 69.+32 <br />BY: MR. COMELLA <br />AN ORDINANCE TO AMEND SECTION 3 OF ORDINANCE N0. 1072 <br />BY REQUIRING A MINIMUM GRADE OF EIGHTEEN INCHES (18") <br />FOR SINGLE FAMILY AND TWO-FAMILY RESIDENTIAL BUILDINGS. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, COUNTY OF <br />CUYAHOGA, STATE OF OHIO, THAT: <br />Section 1. Section 3 of Ordinance No. 1072, entitled "AN ORDINANCE <br />PROVIDING FOR THE ESTABLISHING, SETTING AND CHECKING OF GRADES OF ALL BUILDINGS <br />AND FEES THEREFOR", passed September 16, 1968, is hereby amended to read as <br />follows: <br />"Section 3. In establishment, setting and checking of grades in set- <br />, back lines, the Engineer shall consider the natural topography of <br />the property upon which construction is intended, the finished grades <br />of adjoining premises, the location of public utilities in relation <br />to the premises being improved, the contemplated use of the premises <br />being improved, the contemplated use of the premises and the uses <br />permitted of undeveloped adjoining properties, if any, under applicable <br />zoning regulations. The minimum grade above the street level for <br />single and two-family residential buildings shall be eighteen inches <br />(18"). Any person dissatisfied with the grade finally established or <br />set,by the Engineer may, within ten days, file a Notice of Appeal, in <br />writing, to the Architectural Board of Review of the Village of May- <br />field, which shall consider the criteria required to be observed by Che <br />Engineer, as hereinabove set forth, accord a hearing to all interested <br />parties, including land owners, and may affirm or modify the Engineers <br />determination. The order of the Architectural Board of Review may be <br />appealed within ten days to the Council, by filing written notice with <br />the Clerk-Treasurer." <br />Section 2. Existing Section 3 of said Ordinance No. 1072 shall be <br />repealed as of the effective date of this Ordinance. <br />Section 3. In all other respects said Ordinance No. 1072 shall remain in <br />full force and effect. <br />Section 4. This Ordinance is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, health, safey and <br />welfare of the Village of Mayfield and its inhabitants, for the reason that it is <br />necessary to have a minimum grade for single and two-family residential buildings, <br />and this Ordinance shall be in full force and effect from and after the date of <br />its passage. <br />Passed this 16th day of June, 1969. <br />ATTEST: <br />~J <br />- Pr~idgcrE of <br /> <br />
