i~~ <br />ORDINANCE N0. 69-36 <br />BY: MR. DAMS <br />AN ORDINANCE TO EMPLOY SPECIAL <br />COUNSEL IN THE ANNEXATION PROCEEDINGS <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />COUNTY OF CUYAHOGA, STATE OF OHIO, THAT: <br />Section 1. The Mayor is hereby authorized to employ special <br />legal. counsel to work in cooperation with the Village Solicitor, in <br />opposing the proposed annexation proceedings of a portion of the Village <br />of Payfield before the Board of County Commissioners. <br />Section 2. Said special legal counsel shall be paid for his <br />services at the rate of $25.00 per hour or any fraction thereof spent by <br />him in preparation and the~rate of $150.00 per day or any portion thereof <br />for time spent in the hearing before the Board of County Commissioners. <br />Provided, however, that his minimum compensation in said proceedings shall <br />be in the amount of $500.00. <br />Section 3. This Ordinance is hereby declared to be an emergency <br />measure, necessary far the immediate preservation of the public peace, <br />health, safety and welfare of the Village of Mayfield and its inhabitants, <br />for the reason that said proceedings are pending before the Board of County <br />Commissioners and it is necessary to have additional counsel immediately, <br />and this Ordinance shall be in full force and effect from and after the date <br />of its passage. <br />Passed this 18th day of August, 1969. <br />J <br />MAYO P,$E IDENT OF COUNCIL <br />ATTEST: <br />(SEAL) CLERK-TRE URER <br /> <br />
