(1123.Ok Cont'd) <br />' abutting or other owners in such subdivision and not as public <br />~~ <br />streets, ways, or grounds shall not serve to exempt the seller -___ <br />'from the requirements of these regulations or from the forfeiture <br />herein provided. <br />Sec. 1123.05 APPEALS <br />A developer aggrieved by an action of the Commission in regard to <br />refusal to approve a subdivision may, within 60 days after such refusal, <br />appeal to the appropriate court to correct errors of law and/or questions <br />of fact in accordance with Sec. 711.09 of~the Ohio Revised Code. ~ • <br />Sec. 1123.06 ADOPTION <br />The adoption of and amendments to the Subdivision Regulations may <br />be initiated by the Commission or Council. If initiated by the Council <br />they shall be referred to the Commission, and, after receiving recommenda- <br />tions thereon, the Commission shall hold a public hearing in accordance <br />1 <br />with the provisions set forth in the'Zoning Code. If the amendment is <br />•' approved by the Commission, the Council may adopt the amendment by a <br />majority vote, or, if such amendment is not approved by the Commission, <br />it may be adopted only by atwo-thirds vote of the entire membership of <br />the Council. <br />After adoption, or amendment to the Regulations, a copy thereof <br />shall be certified by the Commission, or the Council to the Cyyahoga <br />County Recorder. <br />~i MVSR • -75- <br /> <br />
