__~ <br />ORDINANCE N0. 69- 43 <br />BY: MR._SCNMrnm <br />AN ORDINANCE TO AMEND ORDINANCE NO, 159, THE ZONING <br />ORDINANCE OF-THE VILLAGE OF HAYFIELD, BY ADDING <br />SECTIONS 4(a) and 4(b) DEFINING "FAMILY" AND <br />PROVIDING AS TO ROOMERS IN CLASS U-1 AND U-2 USE <br />DISTRICTS, AND SECTION 4(c) LIMITING THE NUMBER <br />OF PERSONS WHO MAY OCCUPY A DWELLING UNIT. <br />WHEREAS, under the existing Zoning Ordinance, there is uncertainty <br />as to the meaning of the word "family" in Class U-1 and U-2 uae districts <br />and it is-also uncertain as to whether or not roomers may live in dwellings <br />in such districts, and Council desires to prevent over-crowding in dwelling <br />units, and <br />WHEREAS, Council finds that this amending Ordinance has been <br />submitted to the Village Planning and Zoning Commission for approval, - <br />disapproval, or suggestions, and that said Commission has allowed a <br />reasonable time for consideration and report, and has approved the same <br />in the form herein set forth, and that a public hearing has been had thereon, <br />and notice of such hearing given in the manner provided by law. <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of <br />Mayfield, Cuyahoga County, Ohio, that: <br />Section 1. Ordinance No. 159, the Zoning Ordinance of the <br />Village of Mayfield, is hereby amended by adding the following sections: <br />"Section 4(a). FAMILY <br />In a Class U-1 and U-2 use district, the definition <br />of 'family', as found in Section 2(k) of Ordinance <br />No. 159, is hereby modified and amended to read as <br />follows: <br />'A family means one or more persons, "related by <br />., blood;~marriage or adoption, or not more than <br />three persons of the same sex not related by <br />• ,blood, marriage or adoption, who live together <br />in,a dwelling unit as a non-profit housekeeping <br />• unit, as distinguished from a group occupying <br />-~• a boarding, lodging or tourist house, sorority <br />-• ~~ or fraternity house, hotel or motel.' <br />• Section 4(b). ROOMERS. <br />• In a Class U-1 and U-2 use district, a resident family <br />may rent, not more than two rooms to not more than two <br />persons for periods of not less than one week provided <br />
