SCHMIDT <br />AN ORDINANCE TO TERMINATE THE LEASE <br />OF CERTAIN PROPERTY BETWEEN THE <br />BOARD OF COUNTY CONAfISSIONERS AND <br />THE VILLAGE OF HAYFIELD <br />WHEREAS, on the 11th day of July, 1968, a lease was entered into by <br />and between the Board of County Commissioners of Cuyahoga County, Ohie, and the <br />Village of Mayfield, Ohio, covering a parcel of land known as Cuyahoga County <br />Auditor's Permanent Parcel No. 831-40-1, abutting Beech Hill Road, as more <br />fully described therein, and <br />WHEREAS, said lease provides that the lessee may cancel the lease if <br />it no longer requires the use of said premises for recreational purposes, and <br />WHEREAS, said premises cannot be used for recreational purposes because <br />of the overflow of sanitary sewage in the vicinity and for other reasons, requiring <br />immediate cancelation of said lease. <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, Ohio, that: <br />Section 1. Said lease dated July 11, 1968, between the Board of County <br />Commissioners of Cuyahoga County, Ohio, and the Village of Mayfield, Ohio, covering <br />the property hereinabove described is hereby terminated and canceled, such <br />termination to be effective 90 days after notice thereof is given in writing to <br />the Board of County Commissioners. The Mayor is hereby authorized and directed to <br />give such notice to the Board of County Commissioners. <br />Section 2. This Ordinance is hereby deemed to be an emergency measure <br />necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the Village of Mayfield and its inhabitants, for the reasons stated <br />above, and this Ordinance shall be in full force and effect from and after the <br />date of its passage. <br />Passed this 16th day of March, 1970. <br />ATTEST: <br />(SEAT; CLERK-T ASURER <br />~'~OR- RESIDENT OF COUNCIL <br />
