ORDINANCE N0. 70- 19 <br />BY: MR. EEECIi <br />AN ORDINANCE PROHIBITING DRAWING OF A CHECK <br />ON INSUFFICIENT FUNDS AND PRESCRIBING A <br />PENALTY THEREFOR. <br />Be It Ordained by the Council of the Village of Mayfield, Cuyahoga <br />County, Ohio, that: <br />Section 1. "Credit", as used in this Ordinance, means any contract or <br />agreement with a bank or depository for the payment, when presented, of a check, <br />draft, or order for the payment of money. <br />Section 2. No person, with intent to defraud, shall make, draw, utter, <br />or deliver any check, draft, or order for the payment of Sixty Dollars($60.00) or <br />less upon any bank or other depository if such person, at the time, has insufficient <br />funds or credit with such bank or depository. <br />Section 3. As against the maker or drawer, the making, drawing, uttering, <br />or delivery of a check, draft, or order, payment of which is refused by the <br />drawee bank or depository, shall be prima facie evidence of infent~•, to defraud <br />and of knowledge of insufficient funds in, or credit with, such bank or depository. <br />Section 4. Whoever violates Section 2 of this Ordinance shall be fined <br />not less than $50.00 nor more than $200.00 or imprisoned not more than six months, <br />or both. <br />Section 5.
