DAMS <br /> <br />C© <br />e <br />b <br />L~1 <br />Q <br />W <br />0',3 <br />_~ <br />0 <br />G <br />i~' <br />b <br />V1 <br />Ch <br />Q <br />W <br />AN EDSERGENCY ORDINANCE ENACTED BY THE VILLAGE OF <br />HAYFIELD, CUYAHOGA COUNTY, OHIO, IN THE MATTER OF <br />THE HEREINAFTER DESCRIBED IMPROVEMENT, UNDER THE <br />SUPERVISION OF THE DIRECTOR OF HIGHWAYS. <br />WHEREAS, the Director of Highways is considering improving a portion of <br />the public highway which is described as follows: the improvement of State Route <br />No. 91, known locally as S.O.P1. Center Road, within the corporate limits of the <br />Village of Mayfield by constructing a new four-lane pavement and/or widening and <br />resurfacing the existing pavement between the south corporation line of the Village <br />of Mayfield and a point located 0.12 mile, more or less, north of idilson Mills <br />Road; and in addition thereto by extending a neca storm sewer northerly along State <br />Route No. 91 to a point located 0.10 mile, more or less, north of Thornapple Drive; <br />the length of said improvement being in all 0.85 mile, more or less. <br />Ohio: <br />MOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Section 1. That it is declared to be in the public interest that tie <br />consent of said Village be and.such consent is hereby given to the Director of <br />Highways to construct the above described improvement, in accordance with plans, <br />specifications and estimates as approved by the Director. <br />Section 2. That said Village hereby proposes to cooperate with the State <br />of Ohio, in the cost of the above described improvement as follows: <br />Assume and contribute: <br />(1) The lump sum amount of $4,450.00, said amount being the available and <br />uncommitted 7 1/27, funds received by the Village as set forth in <br />Section 5735.28 of the Ohio Revised Code. <br />(2) One hundred percent (100%) of the costs of adjusting municipally owned <br />utilities to conform with the improvement, inclusive of the cost of <br />engineering, contingencies and other incidental expenses connected with <br />said adjustments. <br />Section 3. That the Mayor of :said Village, is hereby authorized to enter <br />into maintenance and parking agreements and special contractual obligations. <br />Section 4. That upon completion of said improvement, said Village, will <br />thereafter keep said highway open to traffic at all times, and <br />(a) Maintain the improvement in accordance with the provisions of the statutes <br />relating thereto and make ample financial and other provisions for such <br />maintenance; and <br />(b) Maintain the right-of-way and keep it free of obstructions in a manner <br />satisfactory to the State of Ohio and hold said right-of-way inviolate for <br />public highway purposes and permit no signs, posters, billboards, roadside <br />stands or other private installations cuithin the right-of-way limits; and <br />(c) Regulate parking in the following manner: Prohibit parking within the <br />limits of the improvement. <br /> <br />
