ORDINANCE N0. 70-42 <br />BY: MR. LEECH <br />r- <br />AN ORDINANCE REGULATING THE DESTRUCTION AND <br />REMOVAL OF TREES WITHIN THE VILLAGE OF HAYFIELD <br />WHEREAS, the destruction and removal of large numbers of trees growing on <br />„' <br />~ premises in the Village of Mayfield is likely to result in undue erosion of the soil, <br />dust, pollution of the atmosphere, interference with the natural water supply, <br />drainage problems, loss of oxygen, and unsightly and blighted areas, and depressing <br />,of the value of other property in the community. <br />;~, ~ <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, that: <br />' Section 1. No person, firm, association or corporation shall, in any one <br />;calendar year, remove or destroy or cause to remove or destroy, by cutting, burning, <br />bulldozing, or any other means, more than 25 trees having a trunk diameter of 9 <br />'~ cinches or more at distance of 14 inches above the ground level on any lot or parcel <br />r` ~o£ land within the Village of Mayfield without first filing an application for a <br />;~ ;permit for such purpose with the Village Engineer and the Building Inspector. <br />Section 2. Said application shall set forth the name and address of each <br />owner, lessee and person in possession of the lot or parcel upon which said trees <br />'are situated; the name and address of each person who shall be engaged in the <br />destruction or removal of said tree; the statement as to whether such work will be <br />iperformed under a written or oral agreement or contract, together with a copy of the <br />written agreement or contract or a statement of the essential terms of the oral <br />agreement or contract; a statement of the kind, number and dimensions of the trees <br />jto be removed; and a legal description of each lot or parcel, or in lieu thereof, a <br />!description of sufficient detail so that such lot or parcel may be readily located <br />!on the plat map of the Village. <br />Section-3. Said application shall be forwarded to the Zoning Board of <br />Appeals of the Village of Mayfield by the Village Engineer and Building Inspector, <br />together with their report and recommendations thereon. <br />Section 4. The Zoning Board of Appeals shall set a date for hearing on <br />rJ 'said application and shall notify the applicant and any other persons whom the Board <br />deems to have an interest in the matter. The Zoning Board of Appeals, after <br />~~ considering the evidence, shall determine whether a permit shall be granted and <br />F may attach to the granting of the permit such conditions as it deems necessary to <br />promote the public welfare. The Zoning Board of Appeals shall not grant the permit <br />(gyp; .if it finds that such removal or destruction of trees is reasonably likely to cause <br />,~• soil erosion, result in pollution or an unreasonably large loss of oxygen, inter- <br />, ference with drainage and the natural supply of water, or that it will result in an <br />unsightly and blighted condition, or will depress property values in the Village. <br />~~~ In no event shall the permit allow the removal or destruction of trees as described <br />,- in Section 1 of this Ordinance prior-to the time of approval of the preliminary plan <br />'•r of anew subdivision, or if no new subdivision is to be created, prior to the time of <br />' the approval of the development plan or the issuing of a building permit for <br />~j construction on said premises. <br />:~ <br />~+ <br />rJ <br />
