YJ <br />s <br />FIRST: That the COUNTY will improve Zander Road from Wilson Mills Road <br />to a point approximately six hundred (600) feet south of Cedar <br />Road by grading, draining and paving, all in accordance with <br />the plans, specifications and estimates prepared by the <br />Cuyahoga County Engineer. <br />SECOND: That the road improvement?shall consist'o£ grading, draining <br />and paving. The pavement shall be twenty eight (28) feet in <br />width. <br />TNIRD: That the COUNTY will,at its own,expense, make the preliminary <br />survey, prepare the construction plans, prepare and award the <br />construction contract and furnish all supervision during <br />construction. <br />FOURTH: That the VILLAGE SHALL cause to be made at no expense to the . <br />COUNTY all changes in privately owned utility installations <br />of all descriptions which interfere with the construction of <br />the roadway as planned. ' <br />FIFTH: That the VIZLAGB shall require all owners of property abutting <br />the roadway to extend beyond the,limits of the new pavement all <br />water and sanitary and storm sewer connections, required for <br />existing and future buildings before construction operations <br />are started. <br />SIXTH: That the VILLAGE will enact legislation prohibiting pavement <br />opening in the pavement constructed under this contract, <br />except for emergency or necessary repairs to existing utility <br />installations, for a period of five (5) years after completion <br />of the project. Al,copy of this ordittance shall be sent to the <br />County Engineer. <br />SEVENTH: That the portion of the improvement lying within the limits <br />of the VILLAGE is ten and ninety five huttdredths per cent <br />(10.95%) of the whole improvement and that the proportion of <br />the cost to be allocated to the VILLAGE is ten and ninety five <br />hundredths per cent (10,95%) of twenty five per cent (25%) of <br />the cost of the improvement. <br />EIGHTH: That the VILLAGE agrees to pay twenty five per cent (25%) of <br />the cost of that portion of the,road improvement ( exclusive <br />of the items set forth in •the tenth,.eleventh and twelfth <br />paragraphs inclusive) allocated to the V1ZbAGE. <br />NINTH: That the VILLAGE agrees to pay twenty five per cent (25%) <br />of that portion, allocated to the VII,-LAGE, of' the cost of any <br />right of way and property damage resulting from this improvement. <br />` TENTH: That the VILLAGE agrees to pay the entire cost o£ any relocations <br />and adjustments of sanitary sewers, their appurtenances and <br />house conttections made necessary by the roadway improvement and <br />of any new sanitary sewers that may be required within the <br />Village limits. .
