C( ? <br />Ordinance No. 897 <br />By Mr. Mason <br />AN EMERGENCY ORDINANCE PROHIBITING THE CUTTING OF ,ANSC <br />PAVM40T ALONG LANDER ROAD FOR THE PURPOSE,OF , <br />' INSTALI.ING_WATER 0R SEGIER.CONNECTIONS FOR A$ERIOD OF <br />FIVE XEAR$ AFTER THE COMPLETION 0$ THE_PAVII?II;NT. <br />WHERE,AS, the Board of County Commi.ssioners of Cuyahoga County, Ohio, <br />has entered into an Agreement with the City of Mayfield Heights and the <br />, Villages of Mayfield, Pepper Pike and Highlattd Heights for the improvement of <br />Lander Road by the construction oE a concrete pavement, and the portion of <br />' such installation lying within the Village of Mayfield is to be constrUCted <br />i in 1965 or early 1966; and <br />, . .: <br />i <br />WkIEREAS, once the new pavement has been installed on Lander Road, <br />? it will be detrimental to both the Village and the County to have such <br />' pavement cut for a period of five years after its construction; and <br />WHEREAS, it is desirous that such residents be given ttotice o£ the <br />proposed improvement and further given the opportunity to make such install- <br />ation and connections prior to the completion of such proposed pavement. <br />NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, <br />CUYAHOGA COUNTY, OHIO,. THAT: . _ , . . .. .. . . , _ _ , . _ - • <br />Sec. 1.' The Village of Mayfield hereby consents to the improvement <br />of tander Road in the Village of Mayfield by the installation of a pavement <br />as proposed by the plans prepared on behalf of the County Engineer. <br />Sec. 2. After the date on which the ittstallation of said pavement <br />is completed in the Villags of Mayfield, it shall be unlawful to cut such <br />? pavement or to make any opening therein on Lander Road in the Village of <br />? Mayf ield, except for emergency or necessary_repairs to existing utility <br />installations, for a period of five years after completion of the pavement. <br />? Sec. 3. The Clerk is hereby authorized and directed to prepare <br />Notices of the passage of this ordinance and to cause said notices to be <br />' served either personally or at the residence of or by ordinary mail to the <br />? owners of properties abutting said proposed improvement. In the event that <br />any of the owners of said properties cannot be found, the Clerk is hereby <br />authorized and directed to cause notice of the passage of this ordinance to be <br />' published once in a newspaper of general circulation in the Village of <br />Mayfield. .
