<br /> <br />? <br />A G R E E M E N T <br />01CZliUit "A" <br />TklIS AGRE6MEENZ' mede and antered into as of thio ?qtv- day of PV <br />1955, by and between VILIAGE OF WILLOUGHBY HILLS, <br /> <br />and <br />4iAiAm QF N <br />political mubdivisione oF the State of Ohio. <br />WI'TNnSSETH: That <br />Whercas, it is desirable tha[ each of the reapective parties hereto <br />huve aueh additional fire protection which may be afforded by the equipment, <br />nppasatua and peraonnel of the other party when, because of circumstances, <br />ruch additional aid may appear necessary; and <br />Whereae, the leglalative authorities of the parties hereto have taken <br />ac[ion authoriaing the entering into of this Agreement covering the mu[ual in[er- <br />ehange of fire protection services. . <br />? <br />?I <br />, <br />1 ?. <br />I, <br />I <br />? <br />Nota, therefoxe,it is mutually agreed by and between the parties hereto <br />ae £o1loa+e: <br />1. Each pasty hereto Will assist the other party who is primarily <br />responsible for rendering fire protection service within its boundaries upon <br />'y being rnquce[ed so to do by the Chief of the Fire Department of the political <br />subdivlsion requeating such assistance or by the person next in charge tt-reof, <br />by the uee of 1La fire equipment, apparatus and personnel, and w111 render the <br />eame to the political aubdivision calling for such assietance as it rende:s in <br />the perfoxmance of said services withln ita oian political subdivision. Provided, <br />however, thut at no time will the party upon which said request is made be re- <br />quired to re&pond cai[h equipment or peraonnel which is necessary to maintain <br />adequata fise protecCion within Ste own boundariea. <br />2. The equipment, apparatus and personnel responding to said request <br />for additional fira protectior; shall at all times be under the superviaion, order <br />and direction of the persons in charge of the fire department of the subdivision <br />making such call for additional protection. <br />3. That Section 701.02 of the Revised Code of Ohio, insofar as the <br />aame ohall be applicable to the operation of Fire Departmenta, sha11 apply to the <br />contracCing pastiee hereto, and the Pire Department members thereof, during the <br />time aaid membere are rendering service outuide their respective political <br />aubdivieione. <br />? <br />I <br />? <br />k. Said fire department members sha11 be entitled to all the rights <br />and ban¢fite of the [dor4men's Compensation Act to the same extent as when per- <br />foruing eazvicea within their reapective subdivisiona.
