WOODLANE DRIVE AND WOODLANE DRIVn WHIN FUNDS ARB AVAZLABLE 0$ IN THE PROCESS OF_COLI.ECTION AND GIHEN AId,_THREAT OF LITIGATION HAS BEEN RE'idOVED. _ 41HEREAS, pursuant to Ordinance No. 899, the Clerk of the Village of Mayfield, Ohio, duly advertised for bids according to law, for grading, draining and pavittg with asphaltic materials that portion of Tdorton Park Drive hereinaEter described, and all of North Woodlane Drive, Norman I.ane, South Woodlane Drive and 4)oodlane Drive, together with all necessary appurtenances; _and S,TEIEREAS, the bid of Schloss Paving Company in the amount of $82,245.00 is determined by Council to be the lowest and best bid submitted by.a duly qualified bidder. NOGl THEREFORE BE IT ORDAINED BY TNE COUNCII. OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY, OHIO, THAT: _ Sec. 1. All bids, except that of Schloss Paving Company, for grading, draining and paving with asphaltic materials and appurtenances in the streets hereinafter described, are hereby rejected and the Clerk is authorized and directed to return to all bidders, except said Schloss Paving Company, the certified checks which accompattied their bids. Sec, 2. The Mayor and the Clerk o£ the Village of Diayfield, Ohio, are hereby authorized to enter into a contract on behalf of said Village with Schloss Paving Company for the improvement of Worton Park Drive, from Hemingway Road to South Woodlane Drive, North SJoodlane Drive from Wortott Park Drive to Woodlane Drive, Norman I,atte from Worton Fark Drive to Woodlane Drive, South Sdoodlane Drive from Woodlane Drive to its Easterly terminus, and 4Toodlane Drive from North Woodlane Driqe to South Woodlane Drive, by grading, draining and paving with asphaltic materials, together with_all necessary appurtenances, for the sum of $82,245.00, at such time as the necessary funds for that purpose are available or in the process of collection and when all threats of litigation have been terminated, ( except the appeal of Frank Scheer from the assessment on his property).
