ORDINANCE No. 912 <br />By Mr. Benttett <br />,AN ORDINANCE RE4UIRING THE FILI,ING AND COVERING OF <br />pBANDONED OR UNUSED.WATER AND_GAS WELI.S AND_ _ <br />PROVJ,DING A PENAT,T3( FOR VIOLA,TION THEREOF <br />WNEREAS, an emergency exists in the Village of Mayfield, in that <br />there are abandoned or unused water and gas wells 7 inches or sore inside <br />diamater, which are not filled or covered and cottstitute a hazard to human <br />beings, particularly children,and animals who might fall into them. <br />NOW THEREFORE BE IT ORDAINED BY THE COUNCII. OF THE VII,I,AGE OF <br />MAYFIELD, COUNTY OF CUYAHOGA AND STATE OF.OHIO, THAT: .. , <br />Sec. 1. ItT_shall be unlawEul for any person, f irm or corporation <br />owning or occupying any real property in the Village of Mayfield, Ohio, to <br />permit to exist or remain on such property any abandotted or unused water or <br />gas wells 7 inches or more inside diameter without filling the same with <br />gravel, rocks, stones or other equally suitable filling material and placing <br />and keeping a cover made of substantial wood or metal over such non-used or <br />abandoned water or gas well and strong enough to prevent any person from <br />falling into the same, and any animal falling into same. <br />Sec, 2. The Building Inspector shall cause notice in writittg to be <br />given to any person, firm or corporation in violation of Section 1 hereof, <br />requiring such person, firm or corporation to fill and cover said unused or <br />abandoned water or gas well in tlie manner set forth in Section 1 hereof within <br />five days from the date of service of said notice. Said notice may be served <br />on the person, firm or corporation to whom it is directed by handing it personally <br />to such person or to a member of said firm or to an off icer of such corporation, <br />or by sending it by ordinary mail and addressed to the place of residence or place <br />of business of the persott, firm or corporatiott to whom it is directed, or it <br />may be served itt the same manner as is provided by law for the service of <br />summons in civil actiotts. If such service cannot be obtained, it shall be <br />sufficient to attach a copy_of such notice to or to post it on a conspicuous <br />place on said premises or at the site of such abandoned or unused water well. <br />Sec. 3. If said abandoned or unused water or gas well is not filled <br />and covered in the,mattner hereinabove required within 5 days after service of <br />such notice, the Building Inspector shall cause the same to be so filled <br />and covered and the cost thereof shall be paid out of the general fund of the <br />Village, and the owner and occupier of said premises shall thereupon be liable <br />to the Village of Mayf ield for reimbursement for such expense. Upon failure <br />to make such reimbursement, the amount thereof may be certified by the Village <br />Clerk to the County Auditor to be assessed against said property with general <br />taxes and assessments. <br />
