ORDINANCE No. 912 By Mr. Benttett ,AN ORDINANCE RE4UIRING THE FILI,ING AND COVERING OF pBANDONED OR UNUSED.WATER AND_GAS WELI.S AND_ _ PROVJ,DING A PENAT,T3( FOR VIOLA,TION THEREOF WNEREAS, an emergency exists in the Village of Mayfield, in that there are abandoned or unused water and gas wells 7 inches or sore inside diamater, which are not filled or covered and cottstitute a hazard to human beings, particularly children,and animals who might fall into them. NOW THEREFORE BE IT ORDAINED BY THE COUNCII. OF THE VII,I,AGE OF MAYFIELD, COUNTY OF CUYAHOGA AND STATE OF.OHIO, THAT: .. , Sec. 1. ItT_shall be unlawEul for any person, f irm or corporation owning or occupying any real property in the Village of Mayfield, Ohio, to permit to exist or remain on such property any abandotted or unused water or gas wells 7 inches or more inside diameter without filling the same with gravel, rocks, stones or other equally suitable filling material and placing and keeping a cover made of substantial wood or metal over such non-used or abandoned water or gas well and strong enough to prevent any person from falling into the same, and any animal falling into same. Sec, 2. The Building Inspector shall cause notice in writittg to be given to any person, firm or corporation in violation of Section 1 hereof, requiring such person, firm or corporation to fill and cover said unused or abandoned water or gas well in tlie manner set forth in Section 1 hereof within five days from the date of service of said notice. Said notice may be served on the person, firm or corporation to whom it is directed by handing it personally to such person or to a member of said firm or to an off icer of such corporation, or by sending it by ordinary mail and addressed to the place of residence or place of business of the persott, firm or corporatiott to whom it is directed, or it may be served itt the same manner as is provided by law for the service of summons in civil actiotts. If such service cannot be obtained, it shall be sufficient to attach a copy_of such notice to or to post it on a conspicuous place on said premises or at the site of such abandoned or unused water well. Sec. 3. If said abandoned or unused water or gas well is not filled and covered in the,mattner hereinabove required within 5 days after service of such notice, the Building Inspector shall cause the same to be so filled and covered and the cost thereof shall be paid out of the general fund of the Village, and the owner and occupier of said premises shall thereupon be liable to the Village of Mayf ield for reimbursement for such expense. Upon failure to make such reimbursement, the amount thereof may be certified by the Village Clerk to the County Auditor to be assessed against said property with general taxes and assessments.
