ORDINANCE No. 936 <br />By Mr. Walker <br />AN ORDINANCE ADOPTING TNE RULES AND REGULATIONS OF <br />THE OHIO PUBI,IC UTII.ITIES CIXMIISSION AND PROVIDING <br />FOR PENALTIES.FOR,pIOI.ATION THEREDF IN THE VIZ.LAGE <br />4F _MAYE'III.D _ _ . . . .. . . , - . . <br />WHEREAS, this Council deems it in the public interest to make applicable <br />to this Municipality the rules and regulations of the Ohio Public Uhi:lities <br />Commission and to provide for penalties for the violation of this Ordinattce; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VII,LAGE OF blAYFIELD, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO:. <br />Sec. 1. Compliance with State Public Utilities Commission Rules. No <br />motor transportation company, as defitted in OhLO Revised Code 4921.01 and 4921.02, <br />or private motor carrier, as de£ined in Ohio Revised Code 4923.01 and 4923.02, <br />shall operate any motor vehicle on or over the roads, streets and highways in <br />this Municipality in violation of any of the rules and regulatiotts as prescribed <br />by the Public Utilities Commissiott of Ohio. <br />Sec. 2. Display of Tax Card or Equivalent. No motor transportation <br />company or private motor carrier shall operate any motor vehicle for the <br />transportation of persons or property or both for hire on any road, street or <br />highway in this Municipality without carrying thereon an annual tax card or an <br />emergency tax receipt card or a reciprocity tax decal, as required under any <br />administration order of the Public Utilities Commission of Ohio, as authorized <br />and provided under the terms and provisions of Ohio Revised Code 4921.18 and <br />4923,11. <br />Sec. 3. Route. No motor transportation company or private motor <br />carrier shall operate atty motor vehicle on any route other than the route <br />provided Eor in the certificate granted by the Public Utilities Commission <br />of Ohio except as provided in Ohio Revised Code 4921.14. <br />Sec. 4. Liability Insurance or Bond. No motor transportation company <br />or private motor_carrier shall operate any motor vehicle itt this Municipality <br />without having in full force and effect a liability insurance certificate policy <br />or bottd satisfactory to the Public Utilities Commission of Ohio as required by <br />Ohio Revised Code 4921.11 and 4923.08. <br />Sec. 5. Certificate of Necessity Required. No motor trattsportation <br />company or private motor carrier shall operate any motor vehicle in this <br />Municipality for the transportation of persons or property, for compensatiott <br />or for hire without first obtaining a certificate of necessity as required by <br />Ohio Revised Code 4921.07.
