ORDINANCE No. 941 By Mr. Mason AN ORDINANCE TO REPEAL ORDINANCE No. 917 pND TO ADVERTISE FOR BIDS FOR GARBAGE AND RUBBISH PICK-UP A1VD DISPOSAt. WHEREAS, Quigley Disposal, Inc. in June, 1965, submitted a bid for garbage attd rubbish pick-up and disposal, which bid was returned to said company for clarification because of ambiguity as to its meaning; and WHEREAS, Council on November 15, 1965, passed Ordinance No. 917,entitled: "pn Ordinance Accepting the Bid of Quigley Disposal, Inc. for Garbage and Rubbish Rick-up and Disposal" ; and. , WHEREAS, said Quigley Disposal, Inc. was thereafter on two occasions requested by the Village of Mayfield to return the original bid which had been left with it or to substitute a signed copy for it if it had been lost, all this to be done by December 1, 1965, with the warning that no contract could be entered into legally without a bid in the file of the Village; and WHEREAS, said Quigley Disposal,Inc. has wholly failed and refused to return its original bid or substitute for it and Council therefore has no bid in the file on the basis of which any contract can be awarded; and WHEREAS, further the service rendered by Quigley Disposal, Inc. since November 15, 1965, hasLbeen totally unsatisfactory an8 abt ip comp}.fance:with the specificatiotts on which it submitted its original bid. NOW THII2EFORE BE IT ORDAINED BY THE COUNCIL OF THE VII,LAGE OF MAYFI II,D, COUNTY OF CUYAHOGA, STATE OF OHIO, THAT: _ ,-- Sec. 1. Ordinance No. 917 is hereby repealed, and the Mayor and the Clerk-Treasurer are directed not to enter into a contract with Quigley Disposal, Inc, on the basis of any bid submitted prior to this date. Sec. 2. The Clerk-Treasurer is hereby authorized and directed to advertise for bids, open,to all responsible bidders, on the basis of specifications which have been filed with Council, for garbage and rubbish pick-up and disposal from the residential portions of the Village only.
